Chef Knives - Paid for, but Now out of Stock?

A online Australian retailer which runs two online kitchen stores and also online eBay stores. Had some single chef knives advertised for a great price, I think it may have possibly been a mistake as they are an expensive brand that retails for a lot. I purchased 5 and today I reviewed an email saying that "unfortunately our warehouse could not pack your order as we are out of stock" when I purchased the knives it said they were in stock, and another site that links to them said they had 3 in stock.

What are my options here?

Can I demand that they send me the stock I purchased when the stock comes in? Do I have any legal ground here? ACC?
There other online kitchen store they run has the same knife back up on sale but at a much higher price and in stock?

You're entitled to a full refund. That's it.

expensive brand that retails for alot.

If the constant robins kitchen and other similar shops constantly advertising closing down discounts/sales is anything to go by, the margins are INSANE - especially for what looks like ‘high end’ gear.

    Don't waste your time honestly.

    Pick your battles.

  • Replying to Jimmy- Hey yeah I know the margins are insane but these are Wusthof knives, which I know are good!

You can ask if they can keep the money until in stock but they will most likely just cancel and refund. You have no right to demand the order to be filled if they are out of stock or will cost them more to fulfill generally. If you somehow feel misled, there may be other avenues but is it worth your time and effort?

Replying to quantamcat - what is this reply button you speak of?

Sounds like some sort of black magic wizardry.

Often when it's a price error the company will send out a message saying it's "out of stock". Myer has done this many times. All you're entitled to is a refund

Replying to MS Paint - it’ll be the one that says “reply”. I hear that it works but haven’t tried before.

The only suitable course of action is to set fire to their warehouse, I'm honestly shaking right now, I can't believe they would do this to you. Sending thoughts and prayers.

unfair of them to deny you the happiness of having two knives, OP (and three spares)

  • If you thought they only had three in stock why did you order five?

Two words, Tracey Grimshaw… your courage will inspire others to do the same since you were taken away too soon from your knives.

    Thoughts and prayers x
