NSW - Who Is at Fault?

B did not stop at the stop sign. But A has no dashcam footage. Can OzBargain advise who is at fault?

  • You forgot to add the most crucial detail. Who hit who?

    In the absence of dashcam footage, since neither STOP nor GIVE WAY supersedes, the car which rammed into another will be at fault.

      If A hit B then A has some proportion of fault too.

  • Technically both at fault, without dashcam A is screwed alone because cant prove B didnt stop. A is fault as they crashed to another car at a give way sign.

      No B is screwed. He was at a stop sign and then proceeded to enter the intersection where he hit A. This means A was already in front of him meaning it must of done part of the turn already. I guess it might come down to where the damage is on B's car. Any damage on the front of B's car means its B's fault, but if car A hit the side of B's car then A is at fault.

        Car B could have easily stopped & started moving forwards Then Car A hit the front of Car B. The damage location doesnt really tell you alot in this case.

          Only one person who has posted in this thread can tell us what happened with any authority - the OP and hasn’t been back for a few days. Anyone else is going off very little description and a dodgy paint diagram. There’s a lot of ‘definite’ guessing going on.

          Car A cannot hit the front of Car B. Car A can only hit the side of B.
          If Car B stopped and then started moving forward would he be the one that caused the collision?

            You cannot say that with certainty. It depends on split second timing of who entered the intersection when and the speed of both vehicles.

            B could hit the passenger side of A
