Used Car Leaking Water in The Trunk

Hi all,

I have recently purchased a used car from a dealership and found out that there is a major water leakage in the trunk.

It’s only been 2days since I picked it up
What sort of rights can I exercise in this situations?

Thank you in advance.

Update:
I have found existing damage behind the bumper
Metal is bent and ripped.

Obviously water is leaking through it!

    Talk to the dealership first? Isn't it comes with a few days of warranty?

      Need State, Age of car and Kms travelled.

      Most used cars purchased either through dealerships or privately are not covered by any warranty !

      IN NSW the car must be under 10 years old and travelled under 160,000km to be covered by Used Car Dealership statutory 3 month or 5,000km warranty (whichever come first)

      There is NO WARRANTY if car is over 10 years old or travelled over 160,000km
      If it complies then its 3 months or 5,000km whichever come first
      This is for NSW only
      And probably relies heavily in integrety of dealership
      The small and dodgy ones will dodge thier liability

      Probably differs in other states

          1. My reply above is qualified and 100% correct

          Maybe YOU should read into the reply do your research first before jumping to conclusions

          However if the car age information is correct then obviously my post confirms it must be under statutory warranty if purchased in NSW
          Dont know what the law is in other states,

          Manufacturers warranty doesnt apply to accident damaged cars Im afraid to say so wrong on that one as well

          So get your facts right champ

  • Just be firm and request to book it in for a warranty repair.

    If the car is over 10 years old tho you may have some issues in that there is no warranty. But it should be fit for purpose.

    • There are certain warranties assuming you dealt with a Licensed Dealer…if private , buyer beware.

      They strongly suggest that buyers undertake a thorough investigation before purchasing any used car

  • Water always finds the lowest spot, and the boot (trunk) is usually the lowest point. Check all boot and door seals, to ensure they are there and complete.
    I would be taking it back to the dealership asap.
    Sometimes water ingress in a not very old car may indicate a not too successful crash repair?

        Well, that doesn't sound good. Water leaks might be the least of your problems.

    What does the paperwork you signed say about the warranty?

    As for the damage you are SOL.

  • They will tell you that you had the opportunity to inspect it before purchasing.

      Water leak can only be discovered when it rains
      And under the boot floor

        Or by paying for a mechanic to inspect it on your behalf. Before buying the car, of course.

  • Demand a refund from the dealership- you’ll probably need to be a complete douche to get it, but you don’t want to be stuck with the dodgy repairs they’ll do.

    There’s usually a cooling off period on car sales contracts, but my hunch is they’ll have kept the vehicle longer than that “for totally legitimate reasons” after you signed

  • Definitely return the car if there is still cooling off period, probably been crashed and maybe the previous owner didn't have insurance and it got sold privately/at auction

          Worst case, dealer would put some 'no more gap', job done.

    Not sure about American laws regarding used cars.

  • You won’t have any recourse to manufacturer warranty if accident damage, However if it is leaking water and the hole is in the boot floor I wonder if it is perhaps a roadworthy issue. If water can enter maybe exhaust gases can too, That might give you a recourse against the selling dealer in addition to any used car warranty claim.

      • Yes you did smell exhaust gases and when you went looking for how you discovered a gap in the boot where water had been coming through.

  • You wont get a refund. All you can do is speak to the dealer and get them to repair the damage.

    I would approach the dealer quick smart. The longer you take to raise the issue the harder it’s going to be.

    If it is a licensed dealer, they should be a member of the MTA. Also contact them with your issue.

    Spin some bullshit around legal/Small Claims Tribunal.

    warrenty wont cover damage.

    Id check if your state has a cooling off period.

    I did this when i purchased a car ages ago, paid deposit over phone for a used EFxr6. PIcked it up noticed a few things still decided to grab it took it to mate who is a very through mechanic. Found spare bald, sold as everything working but speakers were blown (common on these cars), seat belts had a wear indicator showing.

    Dealer originally said unlucky so i put it writing and mentioned change of mind and there policy. Plus showed some paperwork from my mat the mechanic. Got $200 gift voucher for bob jane, $1000 from car audio shop and seat belt was ordered in from ford.
