Is Domino's service fee misleading or deceptive?

I had my first encounter with Domino's 6% "service fee" the other day (I know, out of the loop!), and I'm wondering if it falls under the ACLs 'misleading and deceptive conduct' when they advertise. For example, I just got a flyer in the mail with '3 large pizzas from $33 delivered', but of course it's impossible to get them to deliver for that price without 6% added. It seems similar to businesses that exclude the GST from their pricing.

Yes, I know the service fee is in the fine print, but given it's not even a flat fee…

Thoughts?

    I used to wonder about that when they would claim $33 with "FREE DELIVERY" but picking it up was $29…

    Not sure what happened, but they no longer claim that. Wonder if became self-aware or were forced to do so.

    Dominos is one of the scummiest businesses in the world. We only tolerated it because their pizzas used to be cheap.

  • I remember looking this up around the time it was first announced and think I can to the conclusion they were able to do it as it's not 6% everyday as on Sundays its 10% and public holidays 15% or something like that. Although it could be argued they really should just increase prices by 6%, then have a 4or5% sunday charge and a 9-10%ph charge.

    Yes, report to ACCC. If enough people report them, they could get fined for deceptive and misleading conduct.

    Its time for the ACCC to crack down on the 'Drip pricing' that is appearing in Australia everywhere. Its very American and we honestly don't want to go down that path.

    • Drip pricing is against ACCC regulations:

      ‘Drip pricing’ is when a price is advertised at the beginning of an online purchase, but then extra fees and charges (such as booking and service fees) are gradually added during the purchase process. This can result in consumers paying more than they initially intended to.

      Businesses must be upfront and clearly disclose to consumers at the start of a purchasing process the types of fees that will apply and when.

      A business can display the price of its services without including the cost of the mandatory booking fee it also charges, but only if it also displays the prices inclusive of the mandatory booking fee. The prices inclusive of the booking fee must be displayed just as prominently as the display of the prices without the booking fee included.

        Drip pricing is against ACCC regulations:

        That it is, but doesn't stop companies 'trying it on' until the ACCC wakes up and does something about it.

        I don't honestly know how places like Ubereats are adding these service fees to the order, as it is clearing 'drip pricing'. So why hasn't the ACCC jumped on them by now.

        The other trend that I'm not keen on, is restaurants adding service charges and/or asking for a tip on top of that again. I can suck up a public holiday/weekend surcharge barely in hope they staff are getting paid more, but not for a weekday.

  • Domino's is currently in the federal court arguing that their instructions to franchisees on how the franchisees should pay employees is an opinion and not a matter of fact, trying to get rid of their responsibility in under payment, shows what type of company they are.

    In addition, delivery is now minimum of $22
