Amazon Harassing Me by Spamming Me Emails Requesting ‘Statutory Declaration’

Any comments asking me to sign Statutory Declaration is not welcome. I do not wish to be harassed over this issue. Other resolution request would be welcome.


My item was delivered to a house with a Black door according to Auspost delivery proof photo. My house has a Red door, the shape of the wall and colour doesn’t match at all either. It’s all on the delivery proof photos.

Talking to Amazon customer service they sent such info to ‘account specialist’ team. That team ‘made a final conclusion’ that the package was properly delivered to my house. I’ve sent the photo of my house and it doesn’t have a black door.
They have been flooding me with email asking ‘statutory declaration’ for this item, and

We have fully investigated this matter, including with the delivery carrier who delivered the package. Based on the outcome of our investigations, we believe the package was properly delivered. In particular we have considered information from our records, as follows which indicate the item as delivered:

  • the timed geocode stamp of the delivery location;

  • information collected at the point of delivery; and

  • the package weight and reported condition.

1) Please note that in the above link there are two authorised formats for Stat Decs in NSW (Eighth Schedule or Ninth Schedule)

2) Either format may be used however I recommend using the Ninth Schedule format on the basis that the declaration wording refers to "punishment by law provided for any wilfully false statement in any such declaration" which may be more successful in deterring customers from making false declarations.

    I think you shouldn't sign it, and you should immediately commence court proceedings over this $100 item.

    Please keep us updated on the progress of this civil suit.

    Because that would be way more interesting and entertaining than just admitting you won't sign it due to identify or other questionable details, and "spite" is unfortunately not one of the tick boxes on a Stat Dec form

    Sign a stat dec and move on with your life, I'm sure this isn't the most pressing issue in your life and you could focus your attention elsewhere. This is how you progress this case further.

    Not signing a stat dec to me would reflect that you're leaving something out and/or hiding something - Not signing a stat dec means you're guilty of something…. if you have nothing to hide and are innocent in this situation then signing a stat dec would cause 0 issues for you

    Add the email address to your email's built-in blocklist / filter and specify that you don't want it to block the domain only that email address, so you will still get Amazon Order emails. You can remove the filter at a later date.

        Theres literally nothing that can hurt you with a stat dec unless you're lying about receiving it.

        I, Kawaii Statdecrefuser, did not receive item xxxxxxxxxxx on date xx/xx/xxxx. The delivery notification showed it was delivered to a house with a polkadotted door when i actually live in a tent.

        Give it a little squiggle in front of a nice jp and youre done!

          That's my thought exactly. Anyone can sign a stat dec provided what they state is true and correct with absolutely 0 repercussions.

          Amazon have requested that and they're well within their right to, OP is declining to sign it, which indicates either what their post states is far from the truth (a lie) or they did get it (eg. the neighbour simply walked over and handed it to them) and OP is doing the good ol' item wasn't delivered to correct address therefore I didn't receive it = money back please.

    This is actually comical, the only reason OP would reasonably be refusing a stat dec is because he has in fact received the parcel.

    For all the arguing hes done in this thread he could of already gone to the JP got them to sign the document and submitted it to amazon.

    They are offering a resolution, all you have to do is play ball. If you cant handle that, stop shopping online. A stat dec is nothing compared to what some others have had to do to get refunds/items.

        Please go hire a lawyer, spend thousands fighting amazon, lose easily and then be forced to pay legal fees. Even better represent yourself and record it please.

    Youve got stuck on this stat dec thing and youve lost perspective.

    The problem you have is that Amazon think you are a liar and you are refusing to make them think different.

    Amazon initially accepted they delivered to the wrong address and investigated the matter. However, the delivery driver swears they delivered the item the correct address. Then Amazon check the geotracking and it shows the item was either delivered to your address or one of your close neighbours.

    Amazon are telling you, they will refund you but they are asking that you at least check with your neighbours.
    This is a reasonable request.
    Youre refusal to do it is unreasonable.

    Amazon are telling you that once you have done that, then they are willing to refund you if you make a statement that you did not receive the item and you have made an effort to locate the parcel with your immediate neighbours.

    Amazon do this so that people dont lie and scam them.

    You refuse to do the stat dec so you must be a liar and scammer. That is the only logical conclusion a resonable person can ever reach.

    There is really only one solution for you to receive your refund and you refuse to take it.

            You have no legal case. You have been offered reimbursement from Amazon with a condition and you have chosen to refuse that offer.

            You have no other means of seeking restitution.

            Your complete inability to explain any rationale for not completing a stat dec is not demonstrative of the intellect required to present a case in court. Nevermind your failure to comprehend that the expense incurred, by going to court will way exceed the $100 cost of your item.

        Sorry but I don't agree, If it was a typo you would be more likely to have said 'Delivered to house with black door, my house has a black door' or 'Delivered to house with red door, my house has a red door' - That's just my opinion

        What I personally think is that perhaps they did deliver to the neighbours house, but your neighbour obviously wasn't expecting an Amazon package, reviewed the address label, realised it was for your address, walked over to your house and handed it to you. You being a clever little thing decided to play the devils advocate of 'It wasn't delivered to the right address therefore I didn't receive it therefore I want my money back'

        Amazon requested a stat dec (which they're well within their right to do) and you have realised that if Amazon or Australia Post have the proof to suggest that you did indeed receive it you could be imprisoned for up to 4 years

    If you have the tracking number then Auspost should be able to work out where it has been delivered to and retrieve it. The photo includes a GPS coordinate of where the package was delivered.

    We recently bought a Boost SIM and Auspost delivered it to the wrong address. We got a message saying it had been delivered but we could see it hadn’t because we were home at the time. We rang their help line and the guy said “close but no cigar, we will get it back and redeliver it”. We had the SIM delivered less than two hours later.

    Not sure if it has been too long now but if you have a tracking number it is worth getting onto Auspost ASAP.

    Frankly I would just sign the Stat Dec and get a replacement or refund.

  • I am going to assume that you have a reason that is valid to you for refusing to sign the stat dec. Here are some other options that may be of use.

    If your house can be seen from google street view you may be able to talk to an amazon rep and get them to see the two pictures are different.

    You can appoint someone as your power of attorney and get them to complete the stat dec for you as your POA. This legally thre same as doing it yourself but you don't have to be there. This will require a lot of other paperwork though.

    Engage a solicitor to act on your behalf. They can take a picture of the front of your door and certify to amazon that it is your door etc. Again expensive but an option.

    Maybe have a good talk to a friend of yours in person and explain what the problem is with signing the stat dec and see if they can assist you by staying with you during the process.

    You cannot just sue someone and take them to court in Australia. There is a whole process that must be followed including mediation etc.

    At a certain point $100 is not worth the stress. Walk away from it.

  • I once watched an episode of some court or criminal show, can’t remember which one, but there was a ‘gentleman’ stating that he couldn’t have committed the crime because he was gifted with an incredibly large appendage, the victim had stated that the perpetrator had a small one. During the trial, one of the jurors turned out to be a plastic surgeon and could tell that the appendage had been altered via surgery. This post reminded me of that episode.

    I had an issue like this but when I told them it's not my house in the picture they organised redelivery and gave a refund lolol.

    Keep us updated on the lawsuit, princess. People like you are a pain in the ass, you were given an option to remedy the situation but choosing not to for absolutely no reason. Stinks of fraud.
