ABN's and .com.au domain names

A business I have had some very unpleasant dealings with after a quick search has registered their domain name with an ABN, which when I look up the says that it was "Cancelled from 05 Feb 2008."

The online store was all around dodgy and I'm still seething about being out of pocked and ripped off. I'm wondering if there is a way to report that someone has a .com.au domain name registered under an inactive ABN?

    You can use auDA's Domain Complain Form.

    … if you think the registrant is not eligible to hold their domain name under the Domain Name Eligibility and Allocation Policy Rules for the Open 2LDs

    Well. With auDA policies getting more and more relaxed and previous experience with submitting complain forms, I doubt they'll do anything.

    Hijack the domain. Create an ABN with a similar business name and ask the registrar to transfer it to you.

    Is then any recourse to get your money back via the credit card you used or paypal?

    I'm with Scotty, the auDA is pretty watery nowadays.

  • Earlier this year I have to deal with a case where someone registered a domain using my ABN — sent the request to auDA, got referred to the registrar (MYOB/SmartHost) and then bounced back and forth between them.

    It is also registrar's responsibility to contact the registrant to make sure they have updated info before they pull the plug — sometimes the registrant might have updated the ABN (business restructure, or business sold to another company, etc) so they might actually have a valid ABN/ACN, but just not shown in their WHOIS. Not having a current ABN on WHOIS might not be a good enough reason to have their domain unregistered.

    Anyway. Good luck. I still think the chance having auDA and the registrar taking action pretty slim.
