        Not necessarily. Paypal is screwed up. They'll ask you to prove to them this is fake at your own cost. How? Where? Not sure and if you can't then you get nothing back.

        • They cannot ask you to send it back because under Australia laws, it is illegal to send counterfeit items through Australia Post.

          Yep, I got burnt buying a counterfeit copy of Photoshop CS3. A few simple photos would have proven that it was fake, but Paypal only accepted 'evidence' via fax.

          I got a friend who is a registered TAFE instructor of Adobe CS software to write a signed letter on tafe letterhead. In the letter he described all the obvious spelling mistakes, the faults on the packaging, the crack file on the CD.

          That wasn't good enough for Paypal, but they don't give you another chance to prove it.

          You get ONE shot at providing evidence by FAX. I'm not a religious man, but every day I pray for Paypal to burn in hell.

        • Unless it is proven to be a counterfeit. First they ask you to prove it's counterfeit. If it is then they won't ask you to return it but give you your money back. If you can't proof it's counterfeit then you get nothing back and get stuck with it.

        • I am currently going through this. I purchased sunglasses from Ozsale. They are FAKE. The motif on the side is wiping off easily. The glass has come up of it's frame and the frame has tiny cracks inside the plastic.

          I lodged a paypal complaint and was asked to provide proof it's fake. I am not sure whom to contact about it. Local sunglass store said they can't do it. They did however say it's fake but won't put it on their letter head.

          Ozsale asked me to return the item to them which i have and they've credited me. Am not happy. I am waiting on replies from the licence holders of these glasses and fingers crossed they contact me before the time runs out.

          My last resort is to do a CC chargeback at the risk of losing my paypal account but paypal is getting so useless i can't be bothered with them anyway.

    • Although both are made in China. Brands want to put their names against quality. Therefore usually brand names would have more stringent and higher quality control compared to the cheaper generic versions.

      The cheaper generic version could be some unsupervised kid off the street with his gang of 10year olds soldering the wires in their garage for all you know.

    EDIT: Well, it's not written anywhere but it is on one of the pictures…

    • Look for the typical disclaimer of "Pictures are for illustration purposes only"

    i've never had a problem with paypal, but i use my own brand of logic:

    "I ordered a product, this isn't what i ordered (as i ordered the real thing), therefore, the item that i ordered never arrived"

    • only works for non-tracked stuff, but its a good (financially, but perhaps not morally) option for ebay sellers that dropship fake/damaged stuff from china etc

  • I just received for the missus, and its got InStyler on the box with the "As seen on TV" logo, so will see how it goes when the missus gets home.
