Hello and thanks for taking the time to fill in our survey.

We are writing to you to verify your eligibility to claim in this promotion.

We understand a number of people claiming the offer clicked through on the survey link from websites unrelated to Ferrero, via links that were posted without Ferrero’s permission or knowledge. We note that clause 5 of the terms and conditions states: To be eligible to claim, individuals must, during the Claim Period, either: (a) receive the promotional eDM; or (b) receive the Linked In message, (in their Linked In account inbox), from the Promoter inviting them to participate and claim.

If you received the survey directly from Ferrero via an email or Linked In, then you are eligible. For verification purposes, please reply to this email by Sunday 5th August 2012 and attach the LinkedIn message or email you received so that we can cross check it.

If you are unable to provide this information, your claim will be deemed ineligible. If that is the case, we will remove your survey information from our database and will not send you a box of chocolates.

      To be fair, if they read the T&Cs, only 1430 claims were going to be accepted anyway.

    thats very cheap act by Ferrero Team.
    Hope some legal actions would be taken against ferrero for this act.

      no legal action, Ferrero just be kicking themselves over how they managed to annoy so many people in one fell swoop, and the negative PR resulting from it.

      What legal action? The promotion was subject to T&Cs. Those stated that only eligible people can claim the deal. End of story.
      I do agree with psionix that companies need to be aware that these types of things get passed on and you can end up pissing a lot of people off if you don't play your cards right.
      They have attracted a lot of people who like chocolate.
      They could keep ALL their details and keep them happy for the price of a few choccies or lose them all and get them annoyed… Are the choccies really worth that?

  • There is really nothing to complain about. The survey is NOT targeted at you, and by partaking it you need to agree with their ToC anyway, which kdavis kindly posted in a comment on the day that "freebie" was posted. At the end it's just time wasted on both ends.

    BTW those peoples directly received the email may not read this forum and if you send them email to confirm they will think it is a spam or virus.

    So do you know what you are doing clearly?

    It would have been better if they sent everyone a voucher to redeem at their local supermarket just as a sign of goodwill. I was really impressed with Cenovis sending out the free bottle of fish oil and still planning to send the jellies later. But oh well, win some lose some as has been said.

    • After the Coles Circle and Woolies Air Wick freebie voucher fiasco, I doubt any intelligent company would do vouchers again.

          Probably won't work well with the outdated supermarket checkout systems.

  • you have to look at this from a cost perspective

    the box is $5? another $5 to send?

    so that's 1,430 x $10? plus someones' time to pack n post

    they wouldnt have budgetted for more
