Front Car Hard Braking and Made Claim after of No Accident, What I/My Dad Can Do Now?

There is what happend and anyone have any suggestions what to do?I feel so bad the such thing happend.
I received a insurance company's letter weeks ago to my father and I didn't open the letter that time because I thought maybe my dad stwitched the insurance company.
Till today I opened the letter it is about a car accident claim made to GIO.I dont know what accident was so I called my dad he told me on 05/02/2023(from the letter)the front car brake hard after yellow light to red light but my dad DIDn't hit the front car,it still have about 20-30 cm distance away from the front car,but the front car's driver is so angry and come to my dad want my dad's car license and my dad gave his license and personal details(YES, it is unbelievable, but my dad is first time been in Australia and he is not good at English at all, also there have plenty of cars behind in line so he thinks give out car license will help) because of no physical contact so the front car driver left and my dad thinks it is solved that's why he didn't tell me nor my mom anything about that day,but now got the claim letter.
My dad said the front car driver took the photo and my car that my dad drive now is not in good shape is was 2nd(more) hand with some front/back/overall paint damage by me when I was student and previous owner
My car have QBE CTP and the claimer(front car driver) is with GIO,I have received the letter about claim but no bills just now, what can I/my dad do?My dad didn't took any photo and no police called as there is no no physical contact also the front car driver told my dad is all good after check his car‘s rear which still have 20-30 cm distance but got my dad's license and details

Sounds like a classic case of insurance fraud. You've learnt a lesson.

Call the insurance company explain it all. Then go to the police station to make a report. Sign a stat dec and hope they go and investigate.

    • OK,thanks,Ill do that

      • Don't do that at all

        1) did your dad have insurance? If so, send letter of demand to his insurer with his written version of events

        If no insurance then

        2) Write a letter in reply. Keep a copy. Even include a stat dec of you want

        3) do not involve police. Waste of everyone's time.

Lawyer up, they're coming after you.. unless your dad did actually hit them and not telling you

    • If my dad hit the car,he will tell my mom and I that day,he dont have to lie to me which is meanless, only problem is he give the his details fro no reason ,lawyer cost more than repair I dont really want to go that far.

Up to you.. just be careful in admitting liability

      ChatGPT to the rescue…

Here's a corrected version of your message: I'm wondering if anyone has any suggestions for what to do. Something happened, and I feel really bad about it. A few weeks ago, I received a letter addressed to my father. At the time, I didn't open the letter because I thought maybe my dad had switched insurance companies. But today, I opened it and discovered that it's about a claim made to GIO.

I didn't know what accident the claim was related to, so I called my dad. He told me that on 05/02/2023 (according to the letter), he was driving and had to brake hard after a yellow light turned red. He didn't hit the car in front of him, and there was still about 20-30 cm of distance between the two cars. However, the driver of the car in front got angry and came over to my dad, demanding his license and personal details.

My dad gave the driver his license and personal details (which is unbelievable, I know), but since there was no accident, the driver eventually left. My dad thought everything was resolved, which is why he didn't tell me or my mom anything about that day. But now we've received the letter about the claim.

According to my dad, the driver of the other car took a photo of our car, which is a second-hand car with some front/back/overall paint damage that was already there when my dad bought it. We have QBE CTP insurance, but the claimer is with GIO. We received the letter about the claim, but no bills so far.

What can my dad and I do? My dad didn't take any photos, and he didn't call the police since there was no accident. The driver of the other car said everything was okay after checking his car's rear, which still had some distance from ours, but he got my dad's license and details.

It is almost correct just the front car brake hard when its turing to red light.

        • +7

This isn’t a thing. You have to stop for red lights. In fact, you have to stop for yellow lights.

If your dad hit the car in front, even if it was a tiny bump, then your dad failed to leave sufficient space, not “the other guy slowed down too fast…”

          • +1

            @pegaxs:

then your dad failed to leave sufficient space

Exactly this. Don’t tailgate. Leave room.

            • @jjjaar: Leave room for what? Idiots who can't drive and panic as soon as the light goes yellow?
But yes, if the light was already yellow then OP's dad should have been prepared to stop.

          • @pegaxs: Thats what I said there is no physical contact with the front car,I said the front car stop hard is because he was angry and I dont know what he is angry about.Onlt if my dad lie to me about everything but it is meanless to lie to me in this case.

          • +1

@pegaxs: For yellow light, you must stop before the stop line, unless you are too close to do so safely.

      • Does ChatGPT do the reverse? Can you type in English text & it responds with a laughable attempt at a poor English language post?

This is what happens when there's no mspaint :(

Your QBE CTP does nothing in this scenario. You don’t have third party property insurance.

If you’re going to drive around with no insurance, at least get a dashcam. (A dashcam would have helped in this scenario)

    • I know but its a bit too later for this case.

      • +2

You should also get third party property insurance. What happened if you or your dad or mum hit a Mercedes for example?

        • Yes,will get one Tuesday, buy a lesson in a hard way which not mistake in my side, thats life

@yuisakas: Why wait until Tuesday? You obviously have access to the internet so get it online

And of course there is the obligatory Whirlpool thread

      Thats me posted there.

          Yes,indeed when its needed

        • haha :) You got downvoted by others but I had to laugh at this.

        • -2

But you still chose to be that person.

        • -2

Yes well , we're not all perfect like you !

        • +4

I hate to be that person, but your English skills really need improving.

The internet is an international place, and I am sure English is not OPs first language.

Now, I don’t know about you, but I can’t write or read that well in any other language (well enough that we still pretty much understood what was going on, even if we had to read it a bit slower), so I’m pretty impressed with their skills.

          • +2

            @jjjaar:

I am sure English is not OPs first language.

I am too. That’s why I said it needs improving. Improved English skills means they will be able to convey what allegedly happened in this accident in a clearer manner for the insurance investigators to understand.

            • @kerfuffle: I get what you mean now, and you’re right. They’re definitely doing well for social communication. Though I think your use of “I hate to be that person” took away the sincerity of the suggestion you were trying to make.

              • +1

@jjjaar: Well there's no way to say your English needs improving without looking like a douche here 🤷🏻‍♀️

                • -1

@kerfuffle: Hey, I’m just following your lead and providing constructive criticism… feels great, eh?

                  • @jjjaar: Given that op/Ops father doesn't have legal backup ie. third party insurance, ESL and the other party's accusation, op should be careful with what he says to the other party's insurance. He may accidentally self incriminate without knowing.

  • OP your dad can contact GIO CTP claims department and explained there were no accident (ie vehicle damaged) occured on that day. You can assist them by sending a pic your dad front vehicle. That why GIO can investigate and deny that person trying to claim a personal injury claim which was never happened in the first place. In the likely hood they would deny his claim for any treatment and wages expenses.

    • OK,thanks Ill do that

    • You make a good point. What damage are they claiming? Property or personal injury? It's never specified in the OP, only that they have CTP with QBE (who won't cover property damage), which I interpreted as yet another driver who doesn't know the difference between Compulsory Third Party insurance and third party property insurance.

      • +1

Usually CTP is refer to Personal Injury. If its property claim and your dad have insured either comprehensive or third party with QBE and let QBE sort it out but still provide pic of your dad front car.
Assuming this guy is trying to claim both property and personal injury at some stage.

      • I dont know but no personal injury claimed I guess, because there has no accident..so only the car might be damaged before that can claim.

ChatGPT has some good suggestions but not all accurate.

I'm sorry to hear about the situation you and your dad are facing. Here are some suggestions on what you can do next:

Contact your insurance company: Since you have CTP insurance with QBE, you should inform them about the accident claim made by the front car driver who has GIO insurance. They can guide you through the next steps and help you understand your options. It's important to inform your insurance company as soon as possible, even if you don't have all the details yet.

Get a copy of the police report: Even though your dad didn't call the police, it's still a good idea to obtain a copy of the police report. You can do this by contacting the police station where the accident occurred and request a copy of the report. The police report can help you understand what happened during the accident and if there were any witnesses.

Seek legal advice: If you or your dad are unsure of what to do next or if you think you might need legal representation, it's a good idea to consult with a lawyer who has experience with car accident claims. They can help you understand your legal rights and options, and guide you through the process.

Gather evidence: If possible, try to gather as much evidence as you can about the accident. This includes taking photos of your car, the other car, and the scene of the accident. You can also ask for any witness statements or contact information from anyone who saw what happened.

Be careful with what you say: It's important to be careful with what you say to the insurance company or the other driver's representatives. Avoid admitting fault or making any statements that could be used against you later on. Stick to the facts as you know them and let your insurance company and legal representative handle the rest.

Be patient: Dealing with car accident claims can be a long and stressful process. Try to be patient and stay calm while you work through the situation. Your insurance company and legal representative will guide you through the process and keep you updated on any new developments.

I wonder if ChatGPT knows the difference between third party insurance and CTP

      • +1

Yes, I can help explain the difference between third-party insurance and CTP.

Third-party insurance and CTP are both types of insurance coverage for vehicles, but they cover different things.

Third-party insurance is a type of insurance that covers the damages or injuries you may cause to someone else or their property while driving your vehicle. It does not cover damages or injuries to your own vehicle or yourself. If you have third-party insurance and you are at fault in an accident, your insurance company will pay for the damages or injuries you caused to the other person or their property.

On the other hand, CTP insurance (also known as Green Slip insurance in some Australian states) is a type of insurance that provides cover for people who are injured or killed in a motor vehicle accident. It is compulsory in most Australian states and territories, and it is paid for as part of vehicle registration. CTP insurance covers the cost of compensation for people who are injured or killed in a motor vehicle accident, regardless of who was at fault for the accident. This means that if you are injured in an accident caused by someone else, their CTP insurance will cover your medical expenses and compensation.

In summary, third-party insurance covers damages or injuries you may cause to someone else or their property while driving, while CTP insurance covers the cost of compensation for people who are injured or killed in a motor vehicle accident, regardless of who was at fault for the accident.
