I'm assuming that for those who purchased it before it was marked OOS have all received the KMart order confirmation and can currently see the Expected Shipping date of Friday 14 April 2023 when you click on the link?
My order status is currently "being prepared" and so I just hope it does not change to "order cancelled".

    • Got the same. First order from KMart

    • 3 orders are " being prepared"

      • Update 14.04.2023 : Kmart cancel and refund 3 of them

  • -6

I'm sick of putting in verification codes . The banks stopped 2 platinum cards and was firing on the 3rd one b4 OOS .
I put in plenty of $19 orders just in case of priority as well .

    • +3

verification codes are great security features. i had my mydeal account hacked and they bought a phone, lucky my credit card asked for a verification code. payment was never made.

      • I don’t mind the email codes but I have been stuck when overseas and they can only send a sms code.

        • It only needs to be 4 digits max . 8 at both of my banks is ridiculous.

        • get an e-sim, you can turn the e-sim on temporarily to receive the SMS while overseas

  • -8

    $10 too expensive.

  • -4

Price error, it will get cancelled.

    • +7

      Thanks for your valuable contribution.

I'm getting my babies tomorrow :)

    • +1

That means nothing. Only once you get shipping confirmation will you know it's coming.

      • Yeah a lot of us got this, so until it has left the shop, not counting my chickens.

        • Not if its a price error or if there even is any stock.

        • @lostgoat Not the numerous times I ordered from Big W. Not pricing error. Order cancelled due to out of stock (or staff couldn't locate stock) although stock available when checking online. Some were available in store but staff didn't see.

        • Nope. They can cancel based on price error or insufficient stock. Take a look at T&C's

        • -4

Oh you must be fresh off the boat. Now let's review what you might be uset to.

          • Left-hand traffic… checked.
          • Somebody offering you a product and already took money for it? Nah, that's far from binding!
          • -5

@pizzaguy: Kmart is not above the laws of the land .
I simply put what it is .
            Contract Law .

            • @lostgoat: I simply tell you HOW it is - they can cancel without any worries. Because it's "a mistake". Pricing error, human error, stock level error. No one's going to fine them.

Why do you think 90%+ comments here are about cancelling? That's, like, an every other day case on OzB. More often IRL.

            • @lostgoat: lol, you are literally new to OzB

        • Correct, it happened before with JB-HiFi price error for the Logitech wheels bundle - price error $99 for the bundle.

I drove to the shop to pickup and the store manager said they cant give the order due to the price error BUT they did not attempt to email / SMS / call me to notify, finally the store manager release the bundle when I mentioned about ACCC.

          • -2

            @MauTauAja: Sure thing correct. Here's a proof:

            Search OzB for "cancellation email".
Search OzB for "mine got cancelled".

            Here's potentially why:

ChatGPT, why an Australian online retailer can cancel my order without being fined for scamming people?

There could be a number of reasons why an Australian online retailer may cancel an order without facing fines for scamming. Here are a few possibilities:

Terms and Conditions: When you place an order with an online retailer, you are typically required to agree to their terms and conditions. These terms and conditions may include clauses that allow the retailer to cancel an order for various reasons, such as if the item is out of stock or if there is a pricing error. As long as the retailer is adhering to their own terms and conditions, they may not be liable for any fines or penalties.

Consumer Law: The Australian Consumer Law (ACL) provides protections for consumers, including protections against misleading or deceptive conduct, false advertising, and unfair contract terms. If an online retailer engages in these types of behaviors, they may be liable for fines or penalties under the ACL. However, if the retailer is simply cancelling an order for legitimate reasons, they may not be in violation of the ACL.

Payment Method: If you paid for your order with a credit card or through a payment platform like PayPal, you may be able to dispute the charge if the retailer cancels your order without a valid reason.

            • @pizzaguy: Getting negged for pointing out how the consumer (our!) law can be improved, because right now it's shitty, and a single deal like this one here results in TWO full pages of antsy comments re whether it's a huge-size retailer mistake or not. And more, most of the peeps assumed it might be

Or perhaps getting negged for linking pretty a hard proof of how often cancellations are discussed, so how much of a problem it is in practice. Apparently it's not only a non-existent issue to some, but also worth a -1.

OzB, such a strange folk. Kinda rich and not caring, kinda into thrift.

      Got your babies yet? :D

Anxiously waiting for my cancellation email…

  • Looks like thet took down the product page. It redirects to the kmart main page.

  • It could be possible they might even have the stock, as I thought if it were to be cancelled, we might have got an indication already.

  • Shows as available online only from search, but redirects back to Kmart.com.au

  • +1

They simply had a couple containers of this set . Limiting customers to 1 at a time transactions for Easter cheer. Doing the hard job of clearing a retiring Lego set for Lego .
    In my dreams lol .

  • +20

I guess those who missed out, it hasn't been your day, your week, your month, or even your year.

    • On the flip side, none of us got any word of the set shipping out. Yet.

    • -1

Will anyone be there for me and give me their set for $9?

    • +1

No one told me life was going to be this way

  • I can't wait for my $9 Lego!!!

  • +1

    Refunded :(

  • +2

Kmart is trash. Really hope no one paid for a onepass membership to get this deal

    • Yeah I thought about it seeing as it's only $4 ($6 saving on delivery) but even then the risk/reward wasn't worth it

  • Cancelled

Is a purchase order legally binding in Australia?
POs do not become legally binding until the seller accepts them. The contract, on the other hand, is a legal document from the beginning, as soon as both parties sign it. The two documents are also different because the purchase orders have no value unless the seller approves them.\

As far as I'm concerned Kmart accepted the order with the order confirmation. They are simply doing an illegal action because they think they can ( too big for the little guy to fight legally ).

    • I hope there's a way to make Kmart procure more stock to fulfill its acceptance of our order. But alas, not sure what we can do

    • -1

Funny to watch how right now everybody's upvoting your cry while our comments in the previous discussion were just negged.

Because, you know, they were made hours BEFORE the Kmart realised the shit happenedthey caused (and won't be punished for that).

I've been as frustrated as you multiple times before. Sometimes they take $9 from you, sometimes $999 while you're sure you've already purchased a product. And in reality you're losing time, missing out on other bargain options and, perhaps the most important, missing your money.

I feel I'll get negged by some anti-fans the second I hit Post Comment thought :D edit: Here we go!

  • +2

Refunded here too. Oh well, worth a shot. Was keen to build MacLaren's Pub MOC!

    • Good thinking here. I demand the highest of fives!

Who has the standard ozbargain threat of legal action document for not honouring a pricing error?

    • +3

      Ask @lostgoat

Kmart cancelled 3 of them LOL - oh well at least I tried

    • +1

      You're an optimist!

  • Order just canceled

  • +1

    Got cancelled :(
Is there anything we can do?

    • +3

Head to your local Kmart. Ask to see the manager. Show them your order confirmation, and explain very calmly and clearly that Australian Consumer Law stipulates that you are entitled to your Central Perk LEGO set at the agreed price, or you will attempt to insert a pineapple into their unlubricated butthole by close of business today

      • +2

I was thinking a nice mature cacti but pineapple will do

    • +1

Just accept that it was an insanely good deal that was highly unlikely to be fulfilled.

  • +3

Sounds familiar and Kmart NZ got away with it

    Kmart NZ:

Kmart under fire for selling products online that are not in stock

Vanessa Horne, Commerce Commission fair trading general manager, said the commission was not currently investigating Kmart concerning its online sales and promotional activity.

  • Lest we forget Bunnings-gate.

  • Thanks everyone from ozbargain for the heads-up yesterday lol

  • -6

That my reward for this deal a clogged up email hehe .
Revoking my vote I can't even neg them :(

    • +2

      How many did you order?

    • Since you seem to be out of pocket by hundreds, maybe taking up that contract law of yours is worthwhile. Fight the good fight lostbroden!

  • Here for the refund

  • +3

Kmart: laundering your $ one price error at a time…

  • Got cancelled as expected

  • Ditto, canceled for me too!

  • Cancelled ;(

    • Shipping notification imminent…

    • +1
