Invoice Strata for Cleaning (Sewerage Spill inside Unit)

Just looking to get some advice. Live on the ground floor of the two story unit complex. I heard my toilet gurgling early last week, that coincided with upstairs using water (washing machine, showering, etc) - I understand this to be the situation as their water runs down to pipes co-located with my toilet, and I was not actively running water in my unit.

In any case, I notified strata of the issue, and they refused to do anything until I supplied them with a plumbers report to verify that the issue is common property related. The very next day, I came home from a meeting to see sewerage contents all over the toilet, bathroom, hallway, and into one of the bedrooms. Called the plumber who rectified the issue (related to tree roots blocking the lines on the outside). I forwarded the report sent to me by the plumber, and strata have agreed to reimburse the cost of the plumbing repairs.

Do I have any grounds to invoice them for the

  1. cleaning I had to do - spending 8 hours bleaching/cleaning/sanitizing the affected areas. I did this myself (didn't hire a cleaner) because I wasn't sure if they were going to deem the original problem relevant to strata, and didn't want to fork out upfront for what I'd imagine a very expensive cleaning process given the nature of the spillage, after already shelling out for a large plumbing bill.

  2. I obviously had to throw stuff contaminated with sewerage material out (approx $150 in items - lucky I don't have carpet)

Your wise advice would be well appreciated

  • Potentially sounds like an insurance claim rather than a reimbursement. If considered as an insurance claim, it may require the excess to be paid which may also be a lot (potentially more than the sought reimbursement).

    No harm in asking the strata / owners corporation to see how they respond - the owners corporation should have building insurance.

    • The discarded items would have been approx $150 in value - so not really worth making a claim under insurance I don't think. Just really freaking grateful I don't have carpet in the house!

  • Toilet gurgling is serious issue damn. Will call plumber asap next time.

    • Yeah, I was hoping to wait for a few days to see if the issue self-resolved, won't be making that mistake again!

  • Sounds like a sh**ty situation, and appears that strata doesn't give a crap about the cleanup costs. Not sure if you should make a big stink about it though, as its hard to claim costs that were not incurred (i.e your own time and labour).

    Next time if you notice any gurgling, I'd suggest going outhouse and upstairs to your neighbour or give the strata a call asap.

  • You don't 'invoice' strata'. They submit an insurance claim and things that are billed out get paid by the insurance company.

    Unless you have an ABN or are a sole trader specialising in this area, I think you're SoL since they won't give you money randomly for doing the work yourself.

  • Yeah, they're not going to pay you for your own time in cleaning. Frankly, I think this is a rort as there are so many things in an insurance situation that you are just expected to do for free, but that's the way it is.

    That leaves you with the $150 worth of stuff. I'd attempt to make a claim through strata for it, and do so relatively formally, but frankly I would expect no recompense on that.

    You won't be paid for your own time, but probably could have been rebated for a professional cleaner.

    The $150 worth of stuff is worth a try though.

  • You probably should have called a plumber when you heard the noise. Do you have that time travelling laser thing by any chance?
