Alternate Accomodation during Major Repairs

Hi,

We've been renting a townhouse since 3 years and were happy with everything but as luck would have it our dish washer died and the owner replaced it with a new one. The JB guys didn't install it correctly causing a slow leak which ruined the flooring in about a month causing all sorts of issues.

Just to keep it short, there were all sorts of dramas, insurance companies involved, dozens of inspections later they agreed to repair and estimated 5 days. The REA asked us to move out on our own expense and said the rent for the time would be reimbursed.

We didn't know anyone who'd keep our entire family for that long nor did we afford to stay in a hotel plus we had a feeling that if it takes longer than that so we left Australia to our home country. Now 2.5 months later the repairs are still undergoing with no firm completion date. The REA now says it might take longer and has asked us to stop paying rent because the insruance company will reimburse the owner but we should find our own alternate accomodation.

We had our return tickets booked according to their last estimate of 4 weeks.

Our kids education is disrupted, my wife can't work so we're losing income etc.. I wonder what are our options.

    should have washed those dishes by hand and used the dishwasher as a cupboard….

  • I'd look at renting a new house. Unfortunately, this one's cooked.

    Sounds like they've tried to do everything they can.

  • Talk to a solicitor to find out what you options are. You may be eligible for compensation depending on responsibility. You signed a contract, you pay the rent then they are responsible to make sure they are providing a livable option, a contract applies to both parties equally.

    • Spoke to TenantsVictoria, they said the rental provider is breaching clause 67 and 68 however your chances of getting the accomodation costs back are slim because VCAT is "skeptical about temporary alternate accomodation".

    Did/do you have renter's insurance? That usually covers the cost of alternative accommodation.

    Start applying for other properties to lease.
