Mazda 3 Shipped and Received The Built Email Twice

Hi,

I placed an order for a Mazda 3 (2024) in May and was told it would be delivered in mid-September.

Last week, I contacted the dealer as I expected the car to arrive, but they informed me that it was delayed until October 24th.

Today, I received another email stating that the Mazda3 has rolled off the production line.

Here is the timeline of emails I received:

  • 22/06: Scheduled
  • 03/07: Built: Your new Mazda 3 has just rolled off the production line
  • 07/08: Shipped: Your new Mazda 3 is en route to Australia
  • 28/09: Built: Your new Mazda 3 has just rolled off the production line (exactly the same as 03/07)

Is it possible that they delivered the car that was supposed to be given to me to someone else?
If that's the case, what can I do?
I paid a deposit of $2,000. The delivery date on the contract is listed as TBD.

I contacted the dealer, they said:

It could be a system error, it has happened before. Your car was delayed at the port. There's no way we would have given the car to someone else. We know less information than you do, you should know more than me. Don't you have the engine number? Has this engine number changed?

There was no engine number in the emails I received. When I asked them for the ship's tracking number, they said they didn't have it.

    Sure, this is the only reasonable explanation, sounds like you need to go down to the dealer and demand some answers.

    • TBD is not legally enforceable, you need to provide the item in the contract by a reasonable time frame.

      Otherwise they can just hold your deposit forever.

      Like putting eta or any non specific 3 letter term.

        No they can't, conditions state if no delivery date is put in then the dealer has up to 3 months to supply the car

  • The dealer had a more important customer and gave them your car, which sometimes happens.
    I friend of mine once ordered a Mazda and the data was ASAP, after being messed around by the dealer and salesman he discovered that not having a date is the worst. He did get advice on a process of sending letters etc. but I don't recall the details.

    Based on his bad experience when I ordered an RAV4 hybrid I insisted on a date and got the car 3 weeks early. But that salesman was a good operator and I suspect that would have happened anyway.

      FYI the date is meaningless if the car has a long wait time (a la rav4 hybrid)

      If there's no date on the contract, OP should be able to cancel after 3 months from point of signing, though then they're back to square one

    Dealers in this day and age have some sort of ego complex, cars sitting on the lot for 4 months, offer to buy the car provided they fix a couple of things (broken centre console, scratched tailgate). "It's a second hand car it comes as is we'll sell it without fixing them".

  • The first build confirmation has to be wrong, you would have got it by now.

    The ship carrying your car has sunk so they built a new one and will ship it to you

  • without a VIN the emails are just spamming you.
