          Yes. Counterfeit implies that we are trying to pass this product off as the real thing, or infringing on a copyright.

          As the design of this chair is no longer under copyright it can be sold as a replica, as long as it is clearly marketed as such.

          I have edited the product description to include a much clearer disclaimer that we are not the original manufacturer of the Ghost Chair.

    It might strictly be legal to sell these in Australia… But they are still under copyright in Europe. They are "replicas" but they are also counterfeit.
    ie. Not genuine. Buyer beware.

      Can you please justify your claim these are counterfeit and how the seller is saying these are genuine? From above the seller has explained why these are not considered counterfeit. Can you provide an argument otherwise?

        Sure :)
        The seller has been open that the chairs are not geniune. That they are not the original designer or manufacturer.
        The chair was released by the italian company kartell in 2001. And they are available in Australia.
        The chairs here are copies. This is legal here but they will not be made to the same standards as the original.
        It is a quirk of our laws that they can be sold here…

          With the definition of Counterfeit being "made in imitation of something else with intent to deceive" (Merriam-Webster) I fail to see how the seller is "intending to deceive" when he has been open that these are copies and even you yourself agree that they are selling these legally.

      Beware of what? We're not in Europe.

      A counterfeit or a fake is generally illegal under copyright legislation. I don't think these impede on such laws.
