[Resolved] Are You Legally Allowed to overtake a Vehicle Turning Right in Single Lane Traffic [NSW]

I can’t seem to find an answer to my question.

Anyone know the answer to this question, in NSW are you legally allowed to over take vehicle on the left when the vehicle infront is turning right into a drive way in a wide single lane traffic.

Below is what I found on the government website. The statement below means any condition or meet all three conditions. Anyone knows?

Overtaking on the left
The only time you can overtake on the left is when the vehicle you’re overtaking is:

  • Waiting to turn right or make a U-turn from the centre of the road
  • Stopped
  • Travelling on a multi-lane road.

To overtake a vehicle turning right or making a U-turn from the centre of the road, you can:

  • Use the left lane
  • Drive on, across or outside edge lines for up to 100m
  • Dive in a bus lane, transit lane or truck lane for a maximum of 100m
  • Drive in a bicycle lane or tram lane for a maximum of 50m.

    NSW Road Rule 141(1)

    141 No overtaking etc to the left of a vehicle
    (1) A driver (except the rider of a bicycle) must not overtake a vehicle to the left of the vehicle unless—
    (a) the driver is driving on a multi-lane road and the vehicle can be safely overtaken in a marked lane to the left of the vehicle, or
    (b) the vehicle is turning right, or making a U-turn from the centre of the road, and is giving a right change of direction signal and it is safe to overtake to the left of the vehicle, or
    (c) the vehicle is stationary and it is safe to overtake to the left of the vehicle, or
    (d) the driver is lane filtering in accordance with rule 151A.

      • Pegaxs comment is copied from the actual legislation, not NSW Transport's website. Legalese is almost always written so it's not vague (except for all the terminology many people don't understand…).

    But yes, pass (I don’t consider it overtaking if they’re stopped or slowing) on the left when they’re turning right.
