Employee Contract Query: Monday to Sunday vs. Monday to Friday - Manager on Leave

Hey everyone,

I recently received my employment contract, and it states that the days of work are from Monday to Sunday. However, I've discussed with HR, and they mentioned that the specific working days should be determined in conversation with my manager. I spoken to the senior there that stated work was from Monday to Friday.

Here's the twist: my manager is currently on leave for this month, which adds a bit of complexity to the situation.

Things I have already done:
1. Contacted fair work and they say that they don't review contracts
2. Contacted law access and they said the same

I'm a bit uncertain about how to proceed. Should I request a change in the contract to reflect my preferred working days, or would it be better to get written confirmation from my manager regarding my actual working days?

I'd greatly appreciate any advice or insights on how to handle this situation, considering my manager's absence. Thanks in advance! 🤔📝

The employment contract should be correct at the time of signing and thus needs to be updated to reflect Monday to Friday working days.

Something like this is considered fairly common for regular working week jobs: https://files.ozbargain.com.au/upload/255280/107362/mtf.png

Sounds like HR is being a PITA and using a template that they don't want to change.
They really should've confirmed this with your manager prior to the job opening.

Get them to update it and wait it out.

If you may be on call or do overtime though, likely you won't get a choice.

What kind of work is it? Is the office or whatever even open on weekends? Seems very strange they want you seven days a week, unless you're an on-call plumber or tech or something.

I've seen this before for a role at a retail head office.
They used Monday to Sunday so that they have the flexibility to say don't work Thursday, you'll be at X store on Saturday for the day.

Put a black line through 'Monday to Sunday' and write in Monday to Friday and initial the change, sign the contract and hand it back in. If they have any issues they will let you know, if they accept it then you;re good to go.

This. Did something similar with a non compete clause, crossed it out and initialled. HR didn't check or care

  • I recently received my employment contract, and it states that the working days are from Monday to Sunday.

Working days or working week? As that sounds like a working 'week' to me. Defines how you are paid etc.

    • Days of working

      • What is the type of role? Would 'others' doing the same role be working on a weekend?

        • It should be a typical monday to friday role in a professional field

  • Your manager usually has a one up, see if you can run it with them

    • my manager is currently on leave for this month

i mean, the manager's boss, usually who would've given the green light for the role (in some shape or form)

  • whos the acting supervising line/manager now if hes away?
