Please help me!

I purchased a RETINA iPad on catchoftheday website at $299. After a month, they said my parcel was lost and refund my money. Did they offence my customer right? If so, what can I do to protect my customer right? I really need your help(T_T) Thanks in advance.

  • Sounds fairly dodgy, but I don't think theres anything you can do. You can advise them you still want the iPad as you purchased it through them, but it seems likely they'll say they have sold out and can only offer a refund. It may also be worth asking for evidence of the item having been sent, so you have the peace of mind that there was an ipad in the first place (rather than them just refunding your money because there was no ipad anyway).

    The main thing to protect yourself, is not bother using the website again (especially when they have these 'sales'). They have extremely few products (in some cases less than 3) and use their "catchathon" to boost site visits, which keeps them as "Australia's most visited online store". It is purely a benefit to them, the likelyhood of you getting a bargain is close to nil and not worth your time or effort.

    • But they said the post office lost the parcel. Is it possible?

      • Its possible Australia Post lost the package, but its rare for them to do this (they have the best service record of any mail servidce in the world). Ask for evidence from COTD that it was initially sent, as usually Australia Post will contact you if a 'poster' reports the package as lost in the mail. As it is a large item, they will have a postage or tracking number you can follow up with Australia Post.

          I had to pick my shipment from Auspost as I did miss the delivery on 24th.

          But you can see "Shipment information approved" status came on the tracking only when I had collected the article !!

          I would suggest you to check with auspost..

        • I will have a check with Auspost. I have checked it before when they said they did not receive the parcel. However, COTD said they have already sent it to Auspost.

  • Did you have tracking on the parcel? If so you can see when it was sent and how far it got.
    As a bye the bye- I have bought a few things from them and never had a problem.

  • Yeah i agree don't ever waste your time with those "catch-a-thon" sales. Rarely Catch of the day will have a good deal for example: http://www.ozbargain.com.au/node/77537 I personally purchased this and it was worth it.

    As for the Catch-a-thon i once was lucky enough to get a Galaxy Tablet i then sold it on ebay and made about a $100 profit. Then i thought to myself i can't believe i wasted my whole day waiting each hour to try and snap up a "bargain."

    The Ipad for $299 was probably the best deal as far as mark down goes. Lately catch a thons have been pretty meh, compared to first few they did.

      • There's nothing you can do, it's up to them if they refund or replace…

    How fortunate for them!

    An item they would be losing $200 on for a silly marketing gimmick suddenly gets lost in the post, so now all benefits to them - the successful promo, the marketing and email sign ups gained, and they don't even have to lose $200 to do it now that you only get a refund. They have been holding onto your money for how long?

    I always thought cotd was suss, but this takes the cake.

    • It is so odd. I also bought a iPad case from there website at the same time and I received it within a few days. However I was waiting almost a month for the iPad. I felt I was cheated.

      Yup, the cynic in me says COTD perhaps never had any iPads to sell.

      "Sell" iPads x ?, receive nice cashflow, generate shipping label but never lodge with AustPost, wait for customers complaint, refund. A nice cheap (free) source of short term funding.

    Seems like the ipads may have been a marketing gimic to get hundreds sitting on their site for the day. I think i'd be talking to ACCC about it. Probably let them know you're doing it.

    In any case if the item was indeed lost, I think COTD has probably received compensation from AusPost for losing their parcel. They would not have to worry about making a loss on a lost item. The OP is unfortunately the one making the biggest loss… losing hope, and facing disappointment. I would be devastated, thinking I was the lucky one who managed to score an iPad. It is almost cruel to be made to feel this way.

    I would definitely escalate this somehow. At the very least I would want COTD to send me an iPad. Not having stock is not a valid reason. This is not a discontinued product. They should go out of their way to make the OP feel better, especially when this is a catch-a-thon.

    Don't give up on this OP! Don't settle for anything less than an iPad.
