How Long Is Too Long to Ask for a Refund?

I purchased some speakers just under a year ago.

Have never been happy with them. They have a buzzing sound when on. Had I known about this I would not have purchased. The ultimate ears speaker I was trying to replace has great sound and no buzzing.

I stopped using them a while ago but haven't gotten around to trying to send them back.

How long is too long to send something back for a refund?

    Have you tried anything to address the buzzing sound? A buzzing speaker is not necessarily a fault with the speaker. Could be crappy cables that are at fault, or you have other stuff causing interference. Like bluetooth transmitters or dongles.

      I went through a similar issue with my kareoke system hooked up to a muteki boom box speaker - had annoying af hum, tried everything suggested by supplier including cutting off the earth pin for the mains psu for the kareoke amplifier (seriously wtf but I was so over it and psu body was double insulated) - turned out both the Chinese supplied no name aux cable and my Belkin tester cable both had issue as the $20 aux cable I got from dj city with a nice braided insulation and better contacts fixed issue.

  • The only way I could kill the buzz from one set of speakers I have was to use my PC's USB port to power the DAC they were plugged into. I tried everything else, all sorts of USB ports, bought expensive power boards, but only the PC would do it.

    I dont think the choice of a refund is up to you. The retailer may decide to replace them for for instead for example.

    • Exactly; the store must comply with the ACL but that doesn't automatically dictate a refund

      • I would argue that a hissing sound that is audible while music is playing is a major failure of a set of speakers. If they were $30 ones from K-Mart, perhaps not, but these were alot more than that.

        • Yeah, but the retailer can offer a replacement first, they don't have to immediately offer a refund.

          • @Switchblade88: Based on the ACCC website. When it’s a major problem the business ‘must give the consumer a choice of a:
            -refund, or
            -replacement of the same type of product’

            This indicates the consumers gets to choose which option they take.

          I would argue that if it's taken you close to 12 months to do anything about it, it's not such a big thing to you. But you may get lucky with a refund rather than a repair / replace.

          How much were they and where did you buy it from? Was it directly from manufacturer or reseller?

        But that is protection to a repair or replacement and not a guaranteed immediate refund, especially after nearly 12 months.

      • Yes, you are legally entitled to stuff, why are you asking for input if you already know that? It doesn't change that that to some people, including me, that you're ethically an entitled person and pathetically resort to telling people off after literally asking for input.

    If the warranty is 12 months, and you’ve tried the options others have mentioned to try to fix it, then take them back. The worst that can happen is they replace them with another pair or fix the buzzing for you.

    If you were the owner of the shop, would you be happy if someone came back to demand a refund after this long?

    Had I known about this I would not have purchased.

    The way you've worded this tells me you already know about the whole ACL thing - makes me wonder whether this "buzzing sound" is simply an excuse to try get a refund. If this buzzing sound is really a problem, you've done yourself no favours by leaving it so long.

    • OP might even have dropped it and pretending it came like that. They also haven't said which speaker or the price.

      Sometimes googling of the model + your issue can get quick solution

      • Well, they can't blame anyone for being suspicious.

        This post reminds me of this post were that OP is saying he had issues from day one and trying to claim a refund after four months,. But also says "….and when it does work, I'm not particularly fond of the phone anyway." Seems like a case of buyer's remorse more than anything else.

    ACCC defines a "Major Problem" as:

    • is unsafe
    • is very different from the description or sample
    • has either one serious problem or several smaller problems that would stop someone buying the product if they knew about them beforehand
    • can’t be used for its normal purpose, or another purpose the consumer told the seller about before they bought it, and can’t easily be fixed within a reasonable time.

    And for resolution:

    When a business sells a product with a major problem, or a product that later develops a major problem, it must give the consumer the choice of a:

    • refund, or
    • replacement of the same type of product.

    You don't need to declare that the problem always existed. Only that it exists now.
