Seller Changed Mind on Refurbished Phone Replacement

Hello OzB brainiacs, need your “expert” opinion 😊

Bought a refurbished phone May last year with one year warranty from eBay seller with very high ratings for around $320. By last November, the phone's screen started to show black spots on left side and flickering all over the screen. There were vertical lines in the middle and the touch screen did not seem to work at all.

I contacted the seller and uploaded a video confirming the issue and returned it after seller request.

Seller technical team completed assessment and offered to proceed with sending a replacement and requested my updated shipping address with transfer of remaining warranty to the replacement phone (no refund was permitted).

I provided address and requested the phone to be shipped before Christmas. On 19/12, before shipping the replacement phone, seller sent a message contradicting early agreement to send replacement phone and said further assessment shows defects was because of me. Since then I haven’t got any phones from seller (not original nor replacement).

I raised that with ACCC and notified seller. ACCC advised to prepare complaint letter which I did and sent to seller just to receive generic response that they’re onto it.

What’s next WA small court or ..?

        wouldn't surprise me if they were stolen phones that are being flogged on ebay, knowing that suburb.

          • @pharkurnell: I've seen worse tbh. Merrylands has nice spots, but you definitely have a "feeling" when you're in the suburb lol.

            Also never forget that just because a suburb might be nice, there are just different crimes. Break ins and car robberies vs financial crime :D

    I mean there are 2 sides to every story…

    You could very well have a faulty display, but is there evidence that something may have physically impacted the screen/bent the phone?

    • Other than saying after receiving the phone that their technician assessed it and offered a replacement??

    Good luck. Chances of getting anything back aside from headache is very slim to zero.

  • Have you tried contacting eBay? That would be the second company to report the problem to, after contacting the seller. eBay is usually very fierce in making sure buyers are happy, often at the expense of sellers.

    • EBay online chat said: …, since the item bought more than 30 days ago, eBay is not in position to take any action on this matter. However, I'd highly recommend you to keep the communication on with your seller in a positive way and try to resolve the issue mutually.

    I wouldn't buy anything like this unless it's from a seller I can walk into and get a problem looked at. Save $50 from eBay but a world of hurt. I keep seeing these posts

      I could buy a dozen iPhones from the money I have saved buying from eBay in the last 20 years.
      You can safely buy on eBay without the warranty hassles of buying a "refurb" phone from some guy in his Merrylands bedroom.

        Yeah I guess that's true. Maybe I'm a bit too sceptical to buy off there haha

  • Buying anything from Ebay, other than a new product via Goodguys, Appliance Online, Officeworks or a seller with a physical store etc, is always going to be hit and miss with warranty (outside the Ebay dispute period).

    Even Amazon is the same.

  • You could bring a minor cases claim in WA - but can you identify the other party correctly, serve the documents on them, and enforce any judgment?
