Worksafe - Is Unpaid Work Still Covered?

If a workplace has regular 'safety/training activities' along with the enticement of free food for all that attend; are ALL attendees covered by Workcover, or only those employees who are ROSTERED on for that period covered?

It's not mandatory to attend, but ALL department employees are invited……however by not attending we don't get the additional training.

But by attending I want to ensure that those who aren't being remunerated ARE legally covered should something go wrong.

TIA

I know it's only 8am, but I think this is the most suspect comment I'll hear all day.

If it's a work event, put on by work, at work, you should be covered

  • Even if you're NOT rostered on that day?

Who turns up to work based training for free? Stuff that joke.

        That makes hens. Cheers

I can't imagine turning up to a work based training event and the dude beside you is getting paid {insert hourly rate here} and you are making jack shite.

  • Thought workers are smart, I am wrong, they are genius.

I would turn up to work training for free because I am covered if something happen. Work smart not harder.

  • Any work-sponsored events, such as Christmas parties, will normally be covered by Workcover.

All that is required is that the activity is being undertaken in the course of a person's employment, which out of hours training would be.

  • But by attending I want to ensure that those who aren't being remunerated ARE legally covered should something go wrong.

What did your work say when you asked them?

Are you asking, if you choke on the free food - you're not covered ? I'd answer, you're not force fed, so no you're not covered if you choke to death.
If you're asking if you participate in training - eg asked to do a hand stand and you fall and break your neck, no you're not covered. Let those being paid to be there do the hand stands.

  • I can’t wait for the court case when someone stands up and goes “but I asked ozbargain and they gave me the wrong answer!”

I’m more wondering how legal it is to not pay people for turning up to safety training. I wonder if that advice came from randoms on the internet too.

    • how legal it is

      Non mandatory open invite loophole…

  • In all fairness the payout should be zero since that what you were getting paid at the time.

I don’t think you understand workcover.

It doesn’t just cover the wages for the shift where an incident occurred. It covers expenses (medical, legal) and lost wages as a result of the incident.

All depends on the accident, duty of care, acts of god etc
