I have received the following email:
An error on the www.dell.com.au online store on 27 March 2009 saw Dell offer the Logitech MX Revolution Rechargeble Cordless Laser Mouse for $34.10
Dell would like to advise you that this was a genuine mistake; Dell has not accepted your order or gone into contract with you. If you have paid by direct deposit (e.g. Internet Banking) or by credit card we will decline your payment and return the payment to you. If you have not yet made payment, please do not proceed to pay Dell this incorrect amount, as your payment will be returned.
Dell offers to either cancel your order or if you would like to proceed to purchase the product at $119.00 including GST, please respond via email, and we will get a Dell representative to call you at the earliest and take you through the ordering process. If we do not hear back from you within next two business days by 3 April 2009, we will consider the order cancelled by you.
The standard terms and conditions listed on Dell’s on-line store state that while all efforts are made to check pricing and other errors, inadvertent errors do occur from time to time and Dell reserves the right to decline orders arising from such errors.
We would like to apologise for any inconvenience caused.

its a pretty epic pricing error if thats the case. The email I received with the specials had the mouse advertised, and it was an image.
If its an image, its not likely that it was generated from a database, so someone would have had to type the price into photoshop or whatever when they were creating the email as well as being wrong in the original database…
if dell dishonor it, office works would have got owned with price matches for nothing. Aren’t officeworks supposed to be mates with dell? sounds like a nice way to slowly send them broke lol…
this is too common, I have just 1st hand experienced with HP, one day it was this price, the other it’s more than doubled in graphic. Given DELL is famous for not honouring mistake and have their bottom well covered in their T&C, good luck with that. No need to jump the gun and vote +ve until someone really gets it. the promo was suppose to run till April 2nd, maybe that was their April fools joke leaked out early!!

So what’s the deal? Is it an actual deal or are Dell pulling another scam/whatever? Or does know one know yet?
I placed my order yesterday, deposited payment into their bank account and recieved a “Dell Order Acknowledgement” email. That’s it, haven’t got any emails from them today.

Problem is back when that happened they took the money from credit cards straight away which entered Dell and the buyer into a contract, since then they don’t charge credit cards until the order is checked and accepted, meaning they are covering their asses if they screw up again. When Dell did the screw up on the cheap desktops (also advertised on this site) the boss of Dell AU was quoted from memory as saying it would never happen again and the error had been fixed, sure enough 2 days later it happened again and this mouse advert is yet another “error”.
Dell won’t send the mice but all this bad publicity will cost them far more then the cost of a few hundred mice. I terminated the sale of a $30,000 server with them when they didn’t honor my desktops I ordered, so personally I feel I am in front in the Dell vs Me battle :)

I dont think it is a pricing error, but of course Dell will claim it so as they cannot meet the demand.
Static ice: $65.
Dell: $34 WITH “$20 off” special. Meaning without the $20 off, it would be priced at $55, which while still being cheap, is comparable with the static ice price.
Of course, this is assuming the static ice price is legitimate.
The mouse is over three years old, perhaps nearing EOL , or perhaps they had too many in storage and the batteries are dying?
Only $65 one I can see on static is a VX for notebooks, the cheapest is $69 when i search for the MX Revolution and its a refurb from www.shoppingsquare.com.au

which is not necessarily a bad thing. As was pointed out, the deal was published as an image, so the argument that it’s a mistake would not hold much water. So maybe they can go with the “We’ve run out of stock” argument, but then again, why did some of us get that error when ordering and some of us didn’t? It’s all pointing to “We’re gonna get it!” so far…
I’m guessing they will honour a few orders and then use the out of stock excuse for the rest.
Just saw this on whirlpool, the easter specials have not been taken down from dell site (can they still claim a price error if they keep advertising it?)

True… but:-
- Dell have done this a number of times now. (This time the item is much cheaper than a system pricing error, thereby affecting many more people)
- They also sent an email with the same price, a step I don’t believe they have done before with ‘pricing errors’
- At what point is this simply unacceptable, despite their disclaimers? Once or twice, fair enough. But again?!!?
- They may still have the offer available on a link (TBC)
It’s the principle of the matter. (Yes I ordered a few for friends so have a vested interest too)
At the least Dell should honour orders for amll numbers which they consider to be for personal use. People who ordered stupid quantities should only get a limited number.

The funny thing is that while this managed to take the number one bargain on Ozbargain, not a single person will be getting the mouse for $34.10 from Dell. A few might get one eventually but not for under $100 each. Some bargain, lol! One of the worst bargains ever (can get the mouse cheaper than $100 without much effort) turns out to be rated one of the best ever.

Lets all call the ACCC, and complain. Hardly worth the effort really, but get some satifaction taking it out on them. Im sure some of you guys are used to it, for me it’s the first time. It’s unbelieveable they get away with it.
Unfortunatly there is no point calling the ACCC. They won’t do anything.
I went through the process regarding CD WOW’s Need for Speed special. Even though they charged my credit card, ACCC said the only thing I could do was take them to the Small Claim’s Tribunal in my state which is a waste of time for the money concerned, in both cases.

I urge everyone to write a complaint to the ACCC and/or other government bodies about this. As has been mentioned, there is no legal contract between us and dell to purchase the product for $34 but you can still make a complaint in regards to Bait and Switch advertising.

If they do not have a reasonable supply of the good available at that price and sell-out very quickly, this may be considered bait advertising. What is ‘reasonable’ depends on a number of factors, such as

If a trader has genuinely underestimated the popularity of a sale product, they may offer you a raincheck so you can purchase the product at the special price when it is re-stocked or offer you an alternative product of an equivalent standard at a similar price. If a trader responded like this, then it is unlikely to be considered bait advertising. “

I’ve just lodged a formal complaint with the ACCC under the Fair Trading Act Section 60 ‘Bait & Switch Advertising’.

This product wasn’t just stumbled across on their website where someone/something inadvertantly put a wrong price against an item. This time they actually marketed/advertised it by sending an email under the pretense of an easter special. Surely this makes it different to the other times Dell has claimed to have made a pricing error. Dell actively chased me for my business using this product at this price.

As per the attached email sent on your behalf the mouse was advertised for $34 and it was available for purchase at that price, and even was available for sale for $33 at the small business division. so your claim that this was a genuine mistake is not valid by any means. as both the advertisement and the shopping cart had the price of $34.10 and your small business division had it on offer for 33$ and a typing mistake would only apply to the advertising and not the shopping carts!!!!!

Furthermore customers were able to price match the mouse at Officeworks upon Officeworks staff calling Dell Sales and confirming that the offer was valid. how can you explain that? How do you explain confirming to another retailer that the price was correct on the first day of the advertisement? and what about the losses cause to Officeworks based on the claim of genuine mistake!!!!!!
Based on the above, I reserve my right getting the Logitech MX Revolution Rechargeable Cordless Laser Mouse at the advertised price of $34.10
Upon failure to confirm so within 2 days, I am afraid I will to take further action with the ACCC, the Fair Trade Office and the small claims tribunal. (if needed)
