  • Somehow l don't think JbHiFi will be honouring any orders. If you read the terms of sale on their website it says that they can withdraw an item or sale at any time. Its been done before. Just go to Facebook and HATE them there Lol.

    • There's been a few promotion sort of things, COTD did it too for $199 and it lasted less than a minute. The general prices (as in, the ones you can consider for more than six minutes, and still be able to purchase) haven't strayed far under 290 afaik. This is just a lower price for the ps3, given it's ending it's lifespan. There isn't much solid knowledge about when a successor is coming.

  • Just a word of warning to anyone who ordered via paypal, JB ran a online sale a while back with a bunch of $5 games which I made two purchases. They cancelled my order due to lack of stock but I noticed I did not receive a refund, I called up JB and they blamed it on paypal, paypal blamed it on JB.

    In the end I think the refund was processed but it took a while.

    I ordered mine, but halfway through Paypal checkout accidentally added the $598 Tekken bundle to my order… $798 got billed to me! Do'oh!

    Asked them to remove the second bundle from my order, they cancelled the entire thing and re-added the $199 bundle.

    Best thing is that the new bundle has free shipping!

  • I would suggest that in this case JB-Hifi have no choice but to honour orders. This was not a pricing error on the website. This was an advertised price. Likewise these are not items which are not readily available. Although the packs may be discontinued, playstation 3's and the games listed are readiluy available to JB Hifi.

    Without going into the laws of contract it is sufficient to say these transactions have all the makings of a contract. The Clause '7.4 JB Hi-Fi will use its best endeavours to supply Orders placed through the Website, however JB Hi-Fi reserves the right to cancel any Order without notice for any reason.' is in breach of the Consumer and Competition acts provisions for unfair contract terms and hence invalid.

    NB: I am not a lawyer and this is not legal advice. If you would like further information I suggest you call the consumer affairs hotline in your state or contact the ACCC. Go get your PS3.

      It's not an unfair term as it's there to protect JB from having to sell to customers when they run out of stock:

      24 Meaning of unfair

      (1) A term of a consumer contract is unfair if:

      (a) it would cause a significant imbalance in the parties' rights and obligations arising under the contract; and

      (b) it is not reasonably necessary in order to protect the legitimate interests of the party who would be advantaged by the term; and

      (c) it would cause detriment (whether financial or otherwise) to a party if it were to be applied or relied on.

      Needless to say it doesn't actually satisfy the other two criteria either. Stop trying to screw over JB. They had a great deal on these PS3s and it just so happens that you missed out.

        Read the last sentence - Because these provisions are so broadly drawn, and are one-sided in their operation, they are unfair contract terms. Explain to me exactly how 'JB Hi-Fi reserves the right to cancel any Order without notice for any reason' does not meet this criteria.

        This is exactly the type of unfair term that the legislation was written for.

          Obviously it was put there to protect JB from selling more stock than they have.

          Really we are arguing a point which would need to be decided by the courts. You have one view, I have another.

          The reality is if people really want this PS3 and put in a legitimate order for it, they should contact the consumer affairs hotline, explain the situation, the term in the contract and how they feel it is an unfair term.

          I know in Victoria CAV can lodge a claim on your behalf. JB-Hifi would likely want this whole mess to go away and will offer you a ps3 - perhaps not at the same price… but cheap enough.

          FYI, I have a PS3 already, and had no interest in this deal. I do however have an interest in JBHifi not screwing people over.

        • I don't think it was JB's intention to screw people over, but I agree, they'll probably 'bribe' you with a cheap PS3 to sweep this under the rug. Anyway, to those whinging, get over it. You were too slow and missed out. The same thing happened with the TouchPad and the same will happen with future bargains.

          It's not like they've taken your money and not given you the console, they've run out of stock, and as a result, are unable to sell you the product. I can't see how this is a point for any debate or discussion. It's like walking into K-mart, seeing a sign that said an item was $5 clearance down from $10, seeing none on the shelf, and then proceeding to complain because they didn't have any left.

          The difference is that these people have for all intents and purposes purchased the item, as per the standard of online shopping.

          Furthermore they have in actual fact entered into a contract with JB-HiFi.

          I didnt want to do this but a contact consists of an Offer, Acceptance and Consideration. Once the contract is made it is must be completed. In this case, the offer was made (Ps3 $198 - This was not an invitation to treat, but an offer). Acceptance was given (Clicked buy now). Consideration was given -this iss something that passes from the purchaser to the seller (in this case the buyer entered in credit card details, and clicked purchase. A promise to pay is considered consideration under law.) The fact that the card was not charged is irrelevant.

          JB Hifi are clearly aware that they are in the contract with the purchasor, hence why they placed the above term into the sale. Hence why we go into the merrygoround of unfair contract terms.

        • i dont think they have run out of stock, they set aside an amount of consoles for this deal, so stock is still available just not at the same price.

          They did run out of stock, of that particular bundle. They can't just go and get the more expensive, newer SKU's (160/320 GB) and give you that. They are completely different products. The fact that they still have 250GB SKU's is astonishing in of itself.

  • Due to lack of availability, JB hifi are able to cancel all orders if they want to. Its in the T & C's. I wouldn't be advertising anything l havent received for sale on ebay just yet coz guess what…IT AIN'T COMING!!!! ROFLMAO!!!!!

          I have been waiting since 2:30 and they responded with an automatically generated response stating that the email is in queue. However we should assume safely that people who received the email will get a 160g PS.

          For the people who ordered the product but then had their order cancelled, I think this is a great compromise by JB. They probably received some nasty complaints though.

      Im fairly sure the community here knows that these type of conducts are happening, I just think overall it is a little disappointed that these conducts exist. Especially since this is a free website and it works due to community contribution. Just have a think about what you are doing, many great community websites fail because people try exploit it too much (eventually it may just bring down a website as great as ozbargain).
