Why are e-cigarette related deals banned?

I just saw a deal removed for being related to a banned item. Just wondering why e-cigarette deals are banned?

    TOBACCO ADVERTISING PROHIBITION ACT 1992 - SECT 15A

    Tobacco advertisements not to be published electronically
    Offence

    (1) A person commits an offence if:

    (a) the person publishes something, or authorises or causes something to be published; and

    (b) the thing is a tobacco advertisement; and

    (c) the tobacco advertisement is published electronically; and

    (d) the tobacco advertisement is published in Australia.

    • I haven't read the legislation, but it would be interesting to know what published in Australia means. What if you had a site with a .com.au aimed at Australian customers, but the content was served from the US?

    E-cigarettes have no tobacco though?
    It's just vaporised Nicotine.

    It would be like banning nicotine patches on Ozbargain.

  • actually, that's true. I used to work for a company that made them - it's pharmacy grade nicotine. Nothing to do with tobacco.

    ps, I have no interest in the business anymore, just sayin' :)

  • I believe you can import the "nicotine liquid" that these efags use, from suppliers in Countries like Germany. The Australian suppliers of the fags give you a link to their counterparts in these countries and show you how to order (import)the liquid. I believe the only impediment is the quantity that can be brought in per shipment. I think you can bring it in from New Zealand too!.
    The alternative, non nicotine,liquids to use with these ecigarettes are things like spearmint and cinnamon….why wouldn't you just chew some gum??

    If you sell e cigarettes in Australia which have NO nicotine, you actually abide by legislation and are not selling a Tobacco related product, hence why there is no Tobacco tax on them.

    If you were to sell imported e cigarettes with Nicotine in them on an Australian site, mailing from an Australian address you would be breaking the law. Each Australian store should be selling NO Nicotine only.

    I agree - nicotine versions should NOT be allowed to advertise, however the T&Cs should be updated to align with Australian laws thus allowing reputable, law abiding Australian retailers to be afforded the same opportunity as everyone else on here.

  • Just an update. I've spoken to the Department of Health but need to follow up with the Advertising Standards Board and the TGA. We should have a resolution to this shortly.

  • Efags are efags, if you can become addicted, they should be banned. Smoking is disgusting, whether it be ciggys or this

    • "This" is not smoking. I'm curious, what is it about the use of an e-cigarette that find disgusting? Smoking a cigarette is one thing, and can understand some people finding it disgusting, but puzzled what you could find offensive about these?

  • E-cigarettes may contain nicotine but does not have the harmful side affected associated with the tar content of regular cigarettes.

    E-cigarettes can be used as a tool for quitting smoking, just like nicotine patches or nicotine gum.

    Yes, nicotine can be an addictive substance, but other addictive substances like caffeine and alcohol are regularly advertised here.
