Speeding Camera Fine - No speed camera sign

Hello,

I recieved 2 seperate speeding fine few days ago on two seperate event same location. I always travelled via the same road, never saw any camera sign, fixed or mobile camera there.

Then I suddenly start receiving this panelty notice (so far 2) and suspect to receive more.

I have been driving very carefully in the past few months always monitoring my speed limit because I am about to give test for full licence and don't want to incur any demerit point.

I never did any speeding nor i received any speeding fine before. I always check my speedometer for my speed limit.

So, in this scenario, what would you advise me.

First of all, is it permitted in NSW to operate a camera without puting sign.

Secondly, what is the likely hood of taking the matter to court.

Please do not use agressive language. I would respect your opinion on safe road, but to me this is completely revenue making machine.

        While I don't believe you deserve to lose your license, I hope you've learnt a lesson to be more careful next time. The speed limit is the law, and it's not something you can just ignore because you haven't been caught or caused any accidents.

  • Mate if your under some sort of duress or "using medication" ..simple,do what the packet says .. do not operate heavy machinery or something like that.

    If you were doing 76 in a 60 zone, then your speedo probably read around 80km/h - they usually show faster than what you are actually doing

      Yeh true. Only recently found out about this. Also, if you get new bigger rimmed tyres for your car, then the speedo discrepancy you mentioned is reduced. This is a result of great circumference of the tyre whilst your axle is still doing thje same revolutions or something.

  • Can't answer your two questions but I think that regardless of whether they were allowed to place cameras without signage would not help you in avoiding a fine. You sped twice and you will lose 8 points in total and will lose your licence unless you can get your full licence in time.

    Also want to ask why a person that 'always checks the speedometer' and has had a licence for 5 years and has recently commenced a 'driving very carefully' phase was caught speeding during the very careful months.

    Also I don't think it is a complete revenue making machine or else they would not take the licences off the people that make the most revenue.

    My assumption is that you speed and are trying to weasel out. But alternatively your speedometer might be giving you false readings.

    My opinion on safe road is 'yes'; please respect it.

    OP, what proof do you have that you were driving at or below the speed limit in the zone where you were fined?

    Seriously… It may be ok for you to speed in other countries and get away with it, but you are in Australia now. Try to abide by some of the customs/laws here?

  • I did not read all the comments, however I wanted to point out two things:

    1)IIRC in some countries/jurisdictions etc, as speed camera can not be placed at the bottom of an inclined road
    2)It is also possible but highly unlikely that the OCR on the camera picked up a similar licenced car (in some countries people especially get a licence plate that can be misleading eg. hoon spelt h00n which will still look like hoon once made)

    Bottom line I think it is a bit tough for the OP.

      Seems you didn't read the start of the forum either. OP has admitted he uses the road regularly.

      If there were signs to say there was camera in operation, OP's excuse would be 'there's no mention of infringements on the sign' lol

    You could write to the Traffic Camera Office and ask for all but one fine to be withdrawn on the basis that if you had received the first fine promptly and before the others, you would not have re-offended.

If you are serious about challenging the fine, the best option is to object to the infringement notice and try your luck in the court system.       • PRB is a Victorian entity. OP is NSW. I'm not sure if they offer a similar system up north.

      One of these offences was 16 over

      • This is Victorian. OP from NSW, but I'm pretty sure the 16km/h offence will cause similar issues there too.

    Were the fines fair?
    Try requesting photos (you'll be able to tell/see where the camera was and if there are multiple cars in the shot you can consider a challenge, take legal advice before any challenge) and a test certification for the device/s that pinged you (if the certificate is out of date you can challenge in court).

    Please note, if you go to court you'll pay a much higher cost if/when you lost.

    Be honest and accept responsibility
    If you don't know where the cameras were how do you know you were going downhill?

    Now I assume you were speeding and are sorry, don't want to do it any more/want to reform, so here is some serious advice to help.

    Are you sure about the limit?
    It is so far over it might be a zone you think is 80 but is actually 60?
    A friends wife got 8 fines in 2 weeks for a road she drove daily for years. She swore that never sped etc, etc
    My friend accepted his wife's word blindly but I checked.
    Turned out the limit was changed many years before and there were 12 + correct signs showing the (lower) limit but she still swore that the limit was the old one from 10ish years before. Haven't had a dinner invite recently. Hmm

    Check the accuracy of your speedo vrs multiple gps units, mine is out (only by 2 km & reads low)
    I suggest get an in car gps, my tomtom XXL ($100 @ Dick Smith via Ozbargain) is more accurate than my speedo and also lets me know the speed limit where I am (this part is not totally up to date but still can highlight if I may be going too fast). Also it makes the speed visible to passengers so you be even more more careful.

    Don't speed, this is the single most important piece of advice how not to get speeding fines and will save thousands (a must for OzBargainers)!

  • Can MOD close this topic please. I think we all agree that:

    1. there is no excuse for someone going over the speed limit by 15km/h multiple times
    2. OP, I feel for you.No one like to pay fines but you were in the wrong, so please stop trying to justify your behaviour with childish excuses.Pay the fines and be grateful that no one was hurt by your speeding.
    3. Learn from your mistakes.Drive safely.
