Living Social refund

I am wondering how to obtain a refund.
The item has not been shipped yet.
I called them up. I said that the item was not as described. They said they would not refund as the item had not been shipped.

Anyone with any success?

"Are products covered by a warranty?

LivingSocial does not make any warranty or guarantee for any products. The product may be covered by a manufacturer's warranty. Please contact the product's manufacturer directly to obtain further information.

LivingSocial adheres to the ACCC guidelines and Australian Consumer Law, which means that we will refund the full price of your products if:

  • They are defective or damaged;
  • They are not fit for purpose;
  • They do not match the description provided on the LivingSocial website
  • They do not meet reasonable quality expectations, taking into account the price and LivingSocial’s description"

    Sorry, can I ask - how do you know item is not as described if the item has not been shipped and you haven't seen it yet?

  • i got one iphone case with opal card sleeves at the back but opal reader cant read it.
    i sent email asking refund now. too bad paid by credit card not paypal otherwise i will initial paypal dispute

  • We had a problem earlier this year and just carried out a chargeback when they um'd and ah'd for too long.

      • Just contact your credit card company, they'll guide you through it. We did it all over the telephone.

  • They usually give an indication of when the item will ship. Is it outside this time frame (plus a reasonable delay?)

    You can't make a claim for the item not as described if you haven't received the item.
