Is It New or Second Hand. What Should The Description Say?

This has bugged me for a while.
I see in the forums here, and probably Ebay, items for sale that the seller says is New. (there is a few new selling phones here).

My opinion is if you have got it from a store and now re-selling it then it isn't New anymore, even if the box is sealed.
If it is untouched and sealed then it can be descripbed as As-New condition or Second-Hand but not New, only Store or manufacturers can sell New goods.

If the person is selling a phone and say it is New does that mean the buyer can send it back to them for replacement or repair or refund if it is faulty like ACCC rules when we buy from a store?

Am I being a pain or should any goods bought from a store or won as a prize and being resold never be described as New.

    You're being a pain. We all know what the difference between 'new' and 'used' is on eBay etc. It's a helpful description to let us know the condition of what we're buying. If everything was listed as used, that would also be a pain. Things like 'new without tags' is also helpful in understanding the condition.

    You're being a pain. 99% of things sold in forums are obviously sold by an individual, not a store.

    I won't even mention how many people have 'touched' the products before it hits the store shelves, save you from nightmares tonight.

      Worse nightmares exist at retail level with opened customer-returned products, well fiddled with, then repackaged and put straight back on the shelf and sold as 'new'.

      It's not meant to happen, retailers deny that they do it, but it's rife in Australian retail.

      I unwittingly bought (obvious after unboxing) a less than entirely new PVR from TGG, and others referenced similar issues with certain items purchased from Dick Smith stores.

      • People need to have a stint in retail to realise how touched and dirty things are actually in stores.

  • I get what everyone is saying but if I buy something from Harvey Normans , take it home and then post it to sell on the forums, it really isn't New is it? I know it will be as good as new, but it isn't New (it has been sold once before?

      It has been sold twice actually, maybe more, manufacturer sells to supplier, supplier to Harvey Norman, hn to you. Everyone knows forum stuff isn't the "new" you're talking about, you would have be an idiot to think otherwise.

        OEM Manufacturer sells to manufacturer sells to Distributor 1 and/or to distributor 2 then sells to retail stores

        So how many hands here for a normal products to be in your hand?
        not counting inter-companies transactions in the manufacturer and in the distributors due to "Tax Redirection"

          Exactly, by ops logic, by the time the products reaches into our hands, it's old as your grandma's panties.

    • products can be returned because of change of mind, etc
      and they just place it back on the shelf….

  • New = Sold in original unopened packaging and with full manufacturer warranty by a licenced retailer.
    Used = All the rest.
