Pay Rates / Awards for Fast Food Joints

Folks, what is the award as a Hungry Jacks crew member (on the registers) for 16 / 17 year old, casual in SE Qld.?

What rates for weekends, public holidays etc ? - I am not sure if HJ and Maccas are special contracts/awards or just a general fast food award.
Seems they don't pay penalty rates at all.

Does any one know for sure? I don't want my son bringing it up at his work 'cos I bet that would mean "sorry we don't have any hours for you this week"

    You can claim wages that are incorrectly paid going back up to six years. I know I've done it - but I didn't claim the six years backpay until I was ready to leave…What do you know, one month after I got my unpaid wages I was made redundant and they changed the job title and employed someone else to do the exact same job.

    Keep all payslips and a diary of the hours worked. Give fairwork a call on 131394 to find out the correct award rates. Consider any unpaid wages as a savings plan until they are ready to quit.

  • For a 16 year old I think it's 11 and hour for a 17 probably around 13-14

  • Are some business exempt from applying award wages if they are under a certain size?

    Because its the minority of small businesses that actually pay award. Usually its quite a bit below award and no penalties. Eg petrol station operator

  • Employers and employees cannot agree to a rate of pay which is less than the applicable minimum wage set out the the relavent award.

    Some employers understand that, worse case, if they get caught they just pretend it was a mistake, pay the employee correctly then get rid of them, and get some other poor sucker in to do the job.

    If you keep your payslips and a diary of hours worked you can always claim the correct ammount with the help of the fairwork ombudsman.

  • After months of work at Harveys I was asked to sign an employee agreement that meant working without penalty rates on weekends and public holidays. After procrastinating over many unfair conditions in the 40-odd page document, I refused. Even though I had rostered hours set for the week ahead, I was told what are you doing here, we will call you when we need you. Never again was called. At another time on an annual Show holiday, I was told that it was not a Gazetted holiday and was treated as a normal weekday.(wrong) These and other employers rely on the fact that you are desperate to have an income or a job, so they take full advantage.
    I fully agree with Iratepirate above. If you need the job, keep a separate diary of your employment history (6 years) and hit the unethical employer with a back-pay demand on you way out the door. Then shame them by mentioning them in forums like this, but only when you no longer work for them. One more thing, always record the initial job interview and then later the job offer interview. 100% of the time, it is the Employer who fails to meet some or all their promises. Often it was those promises that enticed you to accept the position in the first place.

    • These are tough times.

      Your right the employer knows they can get someone who can work under award and without penalty rates.

      Why would they call you up and pay you 2.5x's for the same work as Joe blogs.

      The biggest expense for a company is wages and rent. Together makes up 90% of all expenses. Rent you can't change, but where you can decrease is wages. If you can save 25% on wages a typical small business paying $200k in wages would save $50k a year. Nothing to be scoffed at.

      If your not in a position to be picky then best u take the job and the given rates and dont complain. Or you have a choice to not have a job.

    • In theory a workplace agreement cannot mean the employee is any worse off than an award wage. It needs to pass a fairness test. If you suspect it can be worse off, then you shall speak to your union or bring it up with fairwork australia.
