Received toll notice after vehicle was sold 4 months ago

Long story short, I sold my old car to a guy and did lodge Notice of Disposal to RMS (which i don't have the copy anymore).

Last week, I received 2 toll notices from Airportlinks M7 and 1 from GoviaNetwork. I send them stat dec (which i could only put the guy name in, could not remember his address or license number) and also confirmation from RMS. M7 and Govianetwork replied and told me that I need to provide them the buyer address otherwise they will keep coming at me and fees will be stacking up.

Could anyone advise what can I do in this situation?

    Should have taken your tag.just sign in to your account online and remove the Rego number.

      He/she might not have had a tag. If he/she had a tag they probably wouldn't be sending him/her toll notices, just billing the credit card instead.

    Tell them to piss off. If you lodged the notice of disposal correctly, and the fines are for post this date, then the onus is on them to find the guy. They can do nothing to you. You have no obligation to provide any information further than you sold it prior to the fines.

    Similar thing happened to me with the Sydney Harbour Bridge, told them the car was sold. They came back saying I had to provide the purchaser details, and I told them to piss off and ask the RTA. Did not get any response or further communication from them.

    Tell them that under the Privacy Act, you're not allowed to reveal those details.

    It might be a good idea to ring the toll company and say you want to speak to a manager, straight away. Say you have provided the stat dec, any address you would provide may not be current, depending on when you sold the vehicle. Also mention that yes, they should be able to get this info from the RTA, as they have his name and rego details. If this doesn't work, I'd try to ring the RTA or go in, and ask for the information you are missing. Probably best to first explain the situation with the fines. If you can get anything with the address it will help. I had a similar situation and received close to twenty incorrect notices. I got it from the police that all you need is a stat dec and the company should stop chasing you. However, getting this to take place is hard.

  • Hi all, I did go to a RMS registry to enquire about this incident. However, all they could do is provide me a confirmation from them that the car was disposed at of that date prior the toll service period.

    They refuse to give me the buyer address due to privacy policies ( funny that I gave them those info before).

    As of the buyer, they apparently did not transfer his name to the vehicle. An old trick I guess, to get old owner cope all fines.

    I actually called airportlink m7 and they initially advised I could fill out the Stat Dec without buyer address, now they turn 180 degree and try to plug me in the a$$ with the penalty notice plus admin fees.

    With govianetwork, my wife accidently pay them along with other bills. Well now it's gonna be a drama to get it back ($23).

    • Ok, I'm guessing you got sent an escalated notice? They should have put the fines on hold for investigation, maybe this will take some time and you then got sent an automatic notice.

      Also, what is the actual situation with the car? I am guessing you sold with rego and this wasn't transferred or the buyer never submitted the forms. If so, how is it considered disposed? If it's still in your name, you probably want to get it cancelled asap.

      With the fines, probably best to say you want the fines waived, you have submitted stat decs and the buyer's address is with the RTA. Usually frontline staff can't start investigations or waive fines, so just say you want to speak to a manager.

  • If you did nothing wrong and everything right, stick up for yourself. They treat people like this because they can. Some will just back down or give up. In the end, maybe get some advice from an ombudsman. Sometimes just a mention of this will sometimes change their attitude.

    If you didn't go through the toll and you told the rta about the change of ownership, paid or not, i wouldn't let them get away with it. Imagine how many people go through a similar thing. Perhaps you could put a complaint in writing or email with evidence, photocopy and keep a copy for yourself. Send it to the complaints department or similar. They can't then later on, as does happen, say they know nothing about it.

    Every time you call them you are probably left explaining yourself to a different person and find yourself going in circles. Most people can relate to that frustration. One thing i dislike is being accused of something you have not done. To me it's the principal.

    If you told the rta you no longer own the car after the sale then the rego should link to the new owner. If it doesn't and it is not because of you, i feel it has nothing to do with you. I could be wrong however. Never been in that situation but just because they tell you something does not make it true.

    It may be in the Ts&Cs that the onus is on the owner to notify them separately to a Notice of Disposal to the relevant road authority. That is what happens here; VicRoads does not notify TransUrban of a new owner of a car.

    • They're not obliged to and neither is the owner.

      Its TransUrbans job to find the new owner.
