Should I pay commission ?

Put my house up for sale and signed a contract with the realestate
Told them I want a low key sale, no signs .. Just put it on the net no rush to sell.

About a month later the realestate brings over a buyer and introduces us .. That's about it as I do all the talking.

Realestate leaves and the buyer comes back for another visit on their own terms and we hang out and chat.

If I deal directly with the buyer and the real estate really has done stuff all.. How can I get out of paying them commission? Seeing as they really didn't do much

I'm pretty sure the contract says that I have to pay them and I can't sell to any buyer they put the lead on within 12 months
I get that.

But there has to be a way around this?

    They advertised it and brought you the buyer, you're definitely going to have to pay them the commission.

    • ^ This. There's nothing you can do to get out of paying the commissio by selling to a buyer introduced by the Real Estate agent. The only way "out of this" is to sell to a buyer that you source yourself without the assistance of an agent.

      If you don't want to pay their fees, you shouldn't use their services.

    If your buyer is committed to buy and willing to wait over 12 months then you should be okay, if you want to perform the transaction before 12 months then you will be paying commission.

      I can't see where the OP said that.

      I believe he just said that the contact with the agent says that he cannot privately sell to a lead supplied by the agent for 12 months.

        • It's far from the same thing. You can sell to anyone that you like, except for leads that came from the agent, and you can even sell to those after 12 months.

          Not if the OP did sign something (which we don't know the duration yet)if there is a contract,all enquires have to got through the RE.

        • @nocure: You're right - neither of us knows the duration of what the OP signed, so I'm not sure what point you're arguing.

          The only thing that the OP did confirm (in a wishy-washy "pretty sure" way) was the "cannot sell privately to RE leads for 12 months".

  • If it takes them 12 months to sell it they don't deserve any money…a normal real estate contract is 4 weeks.

    I assumed i couldn't get out of it.. It's just one of those things that while all they did was say 'here is the address - go look'
    They are entitled to their commission as mentioned in the contract :/ … Oh well was worth asking you guys anyway :)

    Oh regarding the contract, it's just a normal one but like all of them their is a clause that says that you can't sell to anyone that the realestate put in your direction within 12 months of the contract finishing with out paying them commission

  • I've just handed over $15k for a weeks work for an agent. Pretty good for them, but I should have sold it myself!

    The agent might have access to systems that will easily enable them to see who buys your house, if you break the contract, you will pay, and it will be worth a little of their time to track down the info for a decent amount of money. No court is going to side with you if you try to push it. The contract is designed to stop people wasting estate agents time by setting up a sale, then pulling out or going with someone else
