Infringement notice on illegal torrent movie download in matter of days!

Hi all, got an infringement notice from my ISP netcube for the first time. Haven't downloaded movie for a while (mainly streaming from Kodi), one illegal download, then bang they got me lol. Content as below:

Dear XXXXX

Netcube has received a claimed infringement from the copyright owners of content you have allegedly downloaded as attached. The IP address provided by the complainant indicates that the conduct occurred over your Netcube Service.

As this type of infringement is taken seriously, it is our responsibility to advise you that Netcube does not condone the use of our internet services for activities which are offensive, illegal, or infringe on the legal rights of other persons. Such activities are expressly mentioned in our Terms and Conditions and these Terms and Conditions are a basis of which Netcube may suspend or terminate the services to you.

Within this claimed infringement notice it is alleged that you, or someone authorised by you, via your IP address has engaged in such activity. If you agree that you did engage in this activity, please cease it immediately. We also ask for you to stop future use and sharing of the exclusive copyright that is alleged to be infringed herein.

I knew the government has authorized companies to pursue copyright infringement, just didn't know it's that full on. I meant I downloaded plenty of stuff before this, never got caught. Did change to netcue as of this month. Could it be Netcube actively reporting users? Apparently this is just a warning, so guess I better be more careful in the future. Better VPN more then ;)

Has anyone else got it too recently? Do we get 3 strikes or something before court action or fine?

P/S THE MOVIE WAS NOT DALLAS BUYER CLUB (SHIT MOVIE ANYWAY)….AND I JUST DOWNLOADED IT 3 DAYS AGO..SHIT'S GETTING REAL GUYS!

    • I have no idea about this but noticed my UAC kept blocking a program from installing called setup.mango.com (or something similar), did some google searches couldn't find any info on it, was fairly sure uTorrent was triggering it so I just canceled the install (would prompt every few days) is this what your talking about?

    A $600,000 bond has to be put in place before they can proceed to seek information on downloaders and they can forfit the money if they try to make eroneous claims financial claims .

  • May be u should try using peer block or peer guardian along side with your torrent client.. its not complete solution when compared with VPN solutions. However it has stopped getting me any further infringement notice.

  • Yeh I had about 5 of those emails about 4 months ago, all from paramount. Had to do the right thing so moved it to trash folder and deleted. Stopped all seeding of those files.

    Would love it if someone with analytical skills could see if there is a correlation between $$$ earned at the box office and amount of so-called copyright infringement notices sent.

    I would bet that for movies where they rake in billions $$$ they would not bother chasing some teenager in oz. Whereas for flops / shit movies like dallas buyers club they will try to claw back every cent. They could just try to make a better movie…

    I am yet to be convinced that online streaming (or piracy if you like) is hurting the hollywood industry. Not when you see reports that x movie has just grossed e.g. $300 million in first day release…

    OTOH there are still tv "stars" being paid up to $1m PER EPISODE (thinking charlie sheen), and around $100,000 for mediocre tv series like nashville, 24, etc. If studios were losing so much money from piracy they could not afford to pay such exorbitant fees. Just my 2c worth.

  • Now that this topic got me started…

    I loved netflix when I first got it it, but now noticed they are scammers when it comes to tv series. This happened to me a few times:

    I would start to watch a show, get to love it, then notice netflix only gave us season one. Looked it up on imdb and saw that there are another 3 sesons available. What could I do? Download the remaining seasons from internet? No, because I am a law abiding citizen :) Instead I ask my daughter to ask her hubby to get me the required missing shows while he is downloading pretty little liars for her…

    Is it illegal to watch shows someone else downloaded???

    If you've ever had any experience with the law and being charged, you'll know that the following means absolutely nothing.

    Simply say alleged? prove without doubt I personally did the download and we'll talk about it. Unless you actually admit to it, or they had someone recording you through the window while you downloaded it - they cant.

    • I think most of this topic assumes civil charges for damages, rather than criminal prosecution. Anyone at anytime can bring civil charges against you. Your neighbour can take you to court and say the loud music you play has caused his cat to have nightmares and claim $10,000 damages for a cat psychologist xexexexe. But seriously, nothing stopping anyone. But you are right. They need to identify you as the person playing the music and not your flatmate.

        I would tell them to show how they know their claim. It's a simple case that you will charge them with illegal wiretapping your communications without a warrant and will notify the police.

    I've been using a VPN for years but I do pay with Paypal so the VPN knows who I am. I might descend completely into paranoia next time and use a fake name and pay by Bitcoin, tumbled or purchased anonymously of course. Or maybe go with a VPN that accepts Darkcoin.

    Bugger, that's not going to work- the VPN will still know my IP address. Oh, man, paranoia is hard work.

  • Sure they know someone from your account downloaded that movie, but they can't prove it was you or anyone else in your house. I'm guessing you have wifi, just say someone must have hacked your wifi and used it to download that movie and you never noticed.

    The police just can't guess it's someone in your house on any criminal matter they have to pin point exactly who it was.

    They cant prove who it was, and without an actual admission from yourself they have no case. Basically tell them to fuuck off. they have to pinpoint it was you, just like the police do with forensics, eyewitnesses, photos and all that.

      All good advice and I would add making a counter privacy/stalking complaint. A department store can't taser shoppers or put cameras in toilets and change rooms to combat shoplifting. These IP-Echelon assholes are crossing the same line.

      • If you read the letter, they use a lot of words that lack detail, and never specifically accuse any body by name. If they started to use names, im sure the OP could file some sort of harrassment of false accusations. Its pretty obvious its a template and they are just hoping enough people will get scared and pay up. AFter all they are hardly going to fly someone from America or send someone from Melb or Sydney to his house. Even if they did send someone, they cant break into his house.

  • I know this is probably going to be an unpopular opinion, but ever since there has been somewhat more significant measures taken at the political level (i.e. it's no accident that Hillary Clinton visited NZ some years ago, and then in the days after, NZ government announces anti-piracy legislation), I think the best solution to this is not to just stop pirating, but stop watching the crap altogether, pirated or not!

    I mean find other things to do. Don't waste your lives watching garbage 'entertainment' which will probably promote Alzheimer's or dementia in later life, consider picking up hobbies outside of watching movies or listening to crap music, or reading complete drivel. Join a sporting club, or a community club, music organisations, do whatever. Take on a long term project, try to make or accomplish something which is productive.

      That's a false dichotomy. It's possible to do all those things and watch movies as well. Are you saying that people who download movies only spend all their time watching movies and have no other interests or hobbies? That's a little silly.
