JB Hi-Fi Buy one get one free dilemma

I found a DVD I wanted and the sticker specified "Buy 1 Season One TV on DVD and get one Season One TV FREE"
Technically it made no mention that the higher priced sticker would be charged. The only conditions mentioned were

  • Applies to stickered stock only
  • Stickered stock only

Common sense says that they'll be charging the higher price one, but this really should be an explicit condition of purchase!
It could be argued that I've bought a (cheaper) Season 1 DVD and now get the (more expensive) Season 1 DVD.

  • It's quite the conundrum you find yourself in. A prickly predicament to be sure.

    JB's online fine print says:

    Selected stock only. Cheapest one free. Must be purchased in the same transaction. Limited time only. Applies to first season only. Finished Sunday October 11th.

    If they don't have a banner or poster detailing the conditions clearly visible as you entered the store, near the product, or at the register, you probably have a valid argument.

    If you don't get the most expensive one free, are you prepared to take it to Fair Trading? If so, make sure you take photos of the sticker and lack of additional promotion signage, and get the manager's name and contact details.

    Like you said…its common sense. Otherwise, in every other BOGOF and 'buy 3 & only pay for 2', people could just buy the $1.00 and get the $60 item for free.

    Sometime soon, stores are gonna have to put up stupid obvious T&Cs like "TV not included", "season as in TV season, not weather season"

    Yes I could have picked a much better word. It's not really a big deal.
    Though I just find it interesting that they didn't explicitly mention that the cheaper one will be free. It's a loophole that can be quite rightfully exploited under their own terms.

  • Though they would be meeting the terms by giving you the cheaper. They didn't promise the dearer one, or the cheaper one, they only promised one, and they can pick which one. That is all they promised.
