ACCC 2 year guarantee- valid for used products?

Hi,

I"m looking at buying a used (Apple) laptop. Several I'm looking at are out of the 1 year apple care warranty. However, I know in Aus the ACCC means we can be protected for up to 2 years.

Does the two year consumer guarantee apply if I'm the second owner?

    Yes, for manufacturing defects and the like (obviously not for problems caused by the original owner).

    The Act gives consumers who buy goods usually acquired for personal, domestic or household use, the right to a remedy from a manufacturer or importer if they supply goods that:

    • are not suitable for the purpose they were sold for
    • do not match the description provided, or any sample shown
    • are not of merchantable quality
    • do not comply with an express warranty.

    The rights apply whether the consumer is the original buyer or a subsequent owner (such as someone who has been given the product or bought it second-hand).

      Anyone have experience claiming this with Apple in particular?

      • I've had two incidents regarding Macbooks.

        1)
        Macbook Pro, logic board fried itself completely, no applecare warranty.
        Went in when it was about 1.5 years old, they told me what was wrong, showed me the invoice, told them it should be covered under australian consumer law, then it was free. The laptop then went in on 3 other occasions, the logic board was replaced again and the entire unibody was also replaced. All up they spent over 2k on it.

        2)
        Macbook Air, was randomly going to sleep all the time, no applecare warranty, this computer was also grey market.
        Went in under a year old, gave it to them, they fixed it no worries no cost.

        • Grey market. That surprises me. They wouldn't do it for me. Should I have been more forceful?Anyone else had this experience?

  • No where in the legislation does it state 2 years.

    It states it must lasting, durable etc for a reasonable time among other things.

    The product is covered as long as you have proof of purchase, whether that's a serial number, a receipt or a video of the buyer actually paying for it etc.

    and look up the model here: http://www.apple.com/au/environment/reports/ and look for where they do their environmental footprint calculations over x years. Usually 5 for laptops and 3 for phones.

    If they are doing calculations over that period of time, it is my opinion that it is reasonable to expect it to last that period of time.

    I've had an iPad replaced after 2.5 years without Applecare after ringing up and saying it didn't last a reasonable time.

    • I think the OP is referring to Apple's undertaking after being spanked by the ACCC not specifically a guarantee under law.

  • ACCC 2 year guarantee-

    Sounds like the Apple laptop they are buying secondhand is from ACCC.
