Discussion: Who's at Fault?

This didn't happen to me. I only came across it in another forum and wanted to see what do you guys think. Who's at fault in this collision?

My first instinct told me that Car B was wrong, as we always need to giveway to cars from the right. However, people did argue that he didn't make any mistake for staying in the left lane before and after the turn.

What're your thoughts, OzBargainers?

        • @ozhunter: If car B gave way there wouldn't be a collision in the roundabout because giving way means car B should've been behind car A, meaning car B would have had let car A passed and exit the round about before entering. Why?.
          And as ridiculous it may sound but the rule says so.
          Why can't you see that Car B actually took a punt entering the roundabout thinking Car A would exit too on the right lane, so it thought it would be safe to enter and exit on the left lane?.
          I know,everyone does it, I do too but I know that's illegal.

          You have a weird definition of "give way". Car B entering the roundabout did not obstruct anyone and Car B remained in its lane. Answer this question -> If this was a T-Junction with three or four lanes, are you saying that Car B would have to wait until all the lanes are clear?

          Why can't you see that Car B entered into the lane that had no other cars in it? The lane Car B was entering into had no cars in it

          If I'm entering into a lane that has no cars in it, who do I give way to?

          If Car A had changed lanes from the inner lane to the outer lane in the red circle in this image and collided with Car B, then I agree it would have been Car B's fault

          ROAD RULES - REG 114 :

          114—Giving way when entering or driving in a roundabout
          (1) A driver entering a roundabout must give way to—
          (a) any vehicle in the roundabout

          You seem to think any vehicle means that only one vehicle is allowed in the roundabout at any given time. Most people interpret it as any vehicle; bus, truck, motor bike, scooter etc.

      you completely dismssed the give way sign that car b had to abide by. The two lanes are present because the two lanes were open from cara original driving position. If car b can turn at any time as you guys are making it out they would have included an island with a left lane split off from the main intersection. Thats the only time that he would be able to continue without giving way to right hand side traffic. Im a little alarmed that people are actually picking car A. Yes hes a silky driver but he disnt break the law . Car b actually broke the law

        Car B did give way. There was no car in the lane it was entering, which is why the image shows that Car B has safely entered into the roundabout.

        If this was a T-junction with and there are three lanes, do you expect all three lanes to be clear before Car B can enter?

      • Car B cannot turn left at any time, it can turn left when there are no cars in the lane into which it is turning to give way to.

        I'm alarmed you think car A can change lanes into a lane occupied by car B directly causing a collision.
