Speeding 140km/h in a 60km/h Zone in NSW

What is the penalty for speeding 140km/h in a 60km/h limit in NSW? I know Roads and Maritime website says >45km/h is license suspension but I heard there is a jail term too?

  • Was it LIDAR or camera van? Got hit with a CAN or not? Hopefully no CAN were dished out on the day and just the usual ~$2300 fine otherwise $2530 plus court fees and suspension period is 6 months minimum. If you also happen to smash the demerit threshold that's a separate suspension in addition to the 6 months but can ask for 12 months good behaviour gamble.

    Get some character reference and lawyer up if you got a CAN to front a magistrate. Good luck.

  • i wouldn't worry about jail time unless you make a habit of speeding recklessly.
    you can almost kill someone, do half a dozen break in etc before you get jail.

      Your child could also be crossing the freeway. Maybe try to get some context before you decide to throw someone in jail.

        Boat speeds in NSW are measured in knots, no? The context is a 60km/h road in which the driver was doing 140km/h (they've already said it was a Lamborghini, I believe). Deserves the book thrown at them - the car being destroyed or sold would just be a bonus. If the OP isn't going to learn through common sense, I'm sure losing a $100k+ car is going to get the message into their head.

    I assume the OP got pinged by a speed camera van or a red light camera as they did not receive an official charges sheet from a patrol officer.

    Firstly, you cannot go to gaol without the state police officially issuing you a charge (eg. reckless driving, evade police, police pursuit). If you were caught by an actual police officer the officer would have issued a hand written charge sheet, a summons to appear in court, plus an on the spot licence suspension for 1 month as its no longer discretionary for speeds exceeding 30 km/h.

    If you got spotted via a speed camera then I am not sure what happens. My guess is that the issue would eventually be looked at by the state police and the charges would be mailed to you. The licence suspension would likely be effective immediately and passed onto the state roads authority.

    Yes, there are charges that do include possible gaol time for a first time offense. If its by a camera van its unlikely you will be issued with any of the serious charges. The reason is because the camera vans are operated by private companies and not the police. All of the serious charges require the police to meet certain criteria before issuing them.

    Eg. Reckless driving = swerving, wheels off the edge of the road, driving in the wrong lane, etc. A camera van cannot substantiate any of these behaviours and your lawyer would easily rectify.

    Assuming its a camera van, the most likely outcome will be a big speeding fine. No licence suspension. No court appearance. No car impound.

    Personally, I despise car drivers who choose to speed in residential areas. Children, fallen cyclists, house pets + wildlife can easily appear from behind parked cars or shrubs.

    If you do it to enjoy the sense of risk but want to stay legal then then get a motorcycle licence and/or take up downhill mountain biking.

    If you enjoy driving cars at high speed the best place is a track day at the race track. Incredibly, it is more expensive to be caught speeding 11km/h than to drive a whole day at the racetrack.

    OP, you are unlikely to face a custodial sentence. That said, unless you are skilled with court room procedures and etiquette, I highly recommend the services of a hyena, sorry, I mean lawyer.

    The breakdown is this. if it was a camera, fat chance you'll see gaol. If highway patrol, more chance, especially if you have a poor driving history, but even then, it would need to be pretty appalling to get custodial.

    Recommendation: Enroll in this asap. www.pcycnsw.org/toip. At your first appearance (really don't plead not guilty for a stall tactic), but IF your lawyer has a few valid tricks and technicalities, go for it, fight it. If not, and you've not completed the course noted in the URL, have the lawyer note that to the courts and ask for an adjournment until course completion. This course will be in your favour and lend better to a possible Section 10.

    There is seldom, and I do mean seldom, ever an excuse to drive at those speeds on AU roads. It's reckless, selfish and ignorant. Go to the track and put your lambo through it's paces, that way if you crash, you risk minimal impact to your life and more importantly, the life of an innocent due to unsafe driving on public roads. I'm a reasonable man, but if you caused death to someone I loved from carrying on at such speeds, your choice would leave me no choice but to leave the country and put a bounty on your skin…

    Excessive speed, driving and texting, DUI (especially high range), reckless/negligent driving all cause death every day and ruins lives. If you are "young dumb and full of cum" as the expression goes, spooge it out with your partner or brothels. Driving a lambo you can afford it. Oh and be glad we don't have laws like Finland, your fine would be in and around the $150K mark… Canada, $10k plus seisure of your car at 50Km/H over. Bye Bye 200k+ vehicle.

    Think about how you'd feel if the coin was turned, if someone plowed into your mother or kids, or anyone you loved at that speed. You'd want him/her dead.

    Honestly, I truly hope you learn from this and realize your actions can carry very grave consequences.

  • 60 zone is for placed that there is a high possibility of people walking or cycling through street and even streets in these zones are not designed for more than 80 speed its insane man.

    I have done speeding of 120-130 in 80Km/hr zones with at least 3 band/line kind of highway roads and i was there is no house in the at least 2km away from that point so risks of hiting someone would be kind of zero. i still did the wrong thing but at least im not stupid.

    The speed limit is there, follow it or else. If you do not like it, do not drive, or leave Australia.
    This is not a laughing matter with innocent others paying the price of injury, death and damage for some other idiots folly and disregard for society and the rules. It is a very serious matter, you should not be making fun of this subject, and anyone saying otherwise is wrong and immature. If you can't follow the rules, do not play the game, and if you need to ask the penaly for such a serious breach of the rules, maybe you should not be holding a licence either.

    If you believe 'it will never happen to me' then why is the term 'near miss' so often used? Why is car insurance and legal liability insurance such a huge industry? Because it is idiots like you on the road, doing what you do best, be an idiot. I love cars more than most, since before mose of you could walk(yes I am a bit old now) as my career, and after hours love with show & go vehicles, but at the end of the day, it is just transport, and effective and safe if by the rules of the road.

    Go play school boy racer on the track, and stay off the streets. You will do much better, have more fun against the clock or another racer where it is safe for the 'just in case' and 'what if senerio', as well as we can all enjoy watching as well. The bonus, we ALL go home safely at the end of the day. I do understand also, motorsport has claimed lives, so, if the unthinkable can happen given everything done to eliminate accidents, what cahnce do you idiots have….next to none.
