Speeding 140km/h in a 60km/h Zone in NSW

What is the penalty for speeding 140km/h in a 60km/h limit in NSW? I know Roads and Maritime website says >45km/h is license suspension but I heard there is a jail term too?

    My partner was hit by a car driving negligently earlier this year. It took three months out of both of our lives. I hope those that make these mistakes learn their lessons hard and those around us learn from their experience. Reckless driving causes suffering in people's lives; the rules are there for a reason.

      I got hit by a car as pedestrian. It took me three years to get back to 90%. Reckless driver run the red also rolled over another kids feet and directly hit me at the bumper rolled over to the windshield and broke it, I was unconscious for few mins thought I was gonna die.

      I totally understand where you coming from. It destroyed me and my partner for the whole three years any kind of compensation didn't really bring back those three years.

      And I was back from honeymoon and it happened few weeks after I got back to work.

      We were planning for family and it destroyed my health totally and wasted my life time of 3 years

          I feel for you and your partner. Rules are there to stop these crazy drivers. Someone's life is on the line and people just take risks and threatening lives.

          To this day I'm still very cautious about crossing at the traffic lights. Still got a permanent problem with my foot. I don't know how to play sports with my kid when he grows up.

          I worked very hard to get back on track with my life. And I strongly believe offenders shall be punished to full extend

          If you got caught and broke the law then you should be fined, punished or jailed

    If they charge you with reckless driving (in addition to the speeding charges) then yes, that is a charge that can carry jail time.

    In my stupid(er) days*, I ended up going to court for 20km/h over and reckless driving. My lawyer was able to argue my super clean history and stated what happened to me was simply an accident. In the end I got a 1 year driving good behaviour bond (basically same as golden point) and if I got done for anything I'd go back to court for the new charge plus the speeding and reckless driving, happily I was good enough to stay clean. I also had to do a defensive driving course and attend a road trauma seminar within that one year. So those charges went away, didn't have to pay the fines but I think I lost the demerit points, but not long after it was all over I had my full license, so all points restored - not that I've needed them!

    Most people need a good scare early on if they're a little too excited by the accelerator pedal. Repeat offenders (with equally as bad or worse offences over time) will probably have the book thrown at them and they'll make an example and statistic out of you.

    *About 3am, was exiting 100km/h freeway, posted speed along the exit was 80km/h (usually in Victoria it's just a recommended speed on exits) and car lost control on a bump and curve in the road and went through some metal fence partitions and came to rest half on an embankment, after a few seconds, it decided to roll onto its roof and rested there. So when the cops took my statement and converted it into writing, it must have just read "guy speeding flipped his car" - hence the charges. Not that I need to defend myself, but for what it's worth, those metal fence partitions had been taken out by other people before my accident, and have been taken out about 20-30 times since my accident too… that I've noticed anyway.

    • I don't see how travelling at only 25 % over the posted speed limit could be the primary cause of a car driver failing to navigate a curve. Speed limits are set conservatively with a safety factor.

      20 km/h over was probably the maximum the Police officer could argue in court beyond reasonable doubt. I'd guess that you were travelling faster than that at the time, or there was some other circumstance which lead to the crash…

      • I dunno what to tell you, it would have been 100km/h or under, as you know, coming off a freeway and such means slowing down, and I knew the limit on the road I was going onto was 80km/h.

        My car had good (not economy) tyres with heaps of tread left, the suspension was fairly heavily modified and very stiff, so the bump in the road must have been enough to unsettle it at that speed I guess. I'd done track work in the car (not by any means a 'performance car' but I had fun anyway) and it handled well on good roads. In any normal car you wouldn't even say the bit of road was bumpy, but my car amplified things like that. Road was dry and I was doing 100km/h or less, they took my statement and decided to charge me with 20km/h over, as you said.

        The off-ramp in question has since had the fence partitions mangled and repaired/replaced about 20-30 times, as I said, they also installed traffic lights there to help the merging traffic, but most of the time it is green and people would do whatever speed they were going to anyway. I don't know what reasons the other drivers had for doing similar to what I did, perhaps poor tyres in wet conditions and the bump with more speed than they should have?

          Mods were handling only: BC BR Coilovers, whiteline front and rear swaybars & endlinks, whiteline anti-lift kit, front and rear strut braces. Wheels borrowed from the WRX model (more tyre touching the road = more grip). Handled like it was on rails, or a go-kart.

    Are you rich and a "well respected" member of the community. Do you have friends and acquaintances serving in Parliament? Are you a personal advisor or senior assistant to a senior parliamentarian?

    If yes to two or more of the above, it shouldn't be a problem. A couple or decent references, a quiet word into the right ears, a brown envelope left on the right desk, and it will all soon be forgotten. If it happened at all….

      Haha. Whenever someone is tailgating me or driving really fast etc. I like to pretend they really have to do a poo and it just makes me laugh instead of being frustrated. Highly recommended.

  • Normally, I'd take the side of someone who gets busted speeding a little like 10-20km/h or so over because I don't agree with the way they have set these artificially low speed limits and then put cameras everywhere… obvious revnue-raising exercise.

    So going by the above, I'm no angel out on the road myself…. but seriously.. 80km/h over?? If you didn't get stopped by the cops, the next lightpole probably would've stopped ya (and crushed your car with you in it).

      There are plenty of 60km/h roads in regional areas with very limited entry and exit, no pedestrians and long, very visible, straight parts on smooth tarmac.

      These roads are often 60km/h because of a few turns before or after these sections. The whole road has a lower speed as there are often fewer speed changes on less used roads.

      140km/h in a 60km/h zone on open roads is always stupid. But there are parts of 60km/h roads, if closed for a private event, where it could be relatively safe.

      Speed limits are good and for the safety of everyone. They take into account many things that most people don't think about.

    My friend was caught speeding with motorcycle for almost 200 kmh, somewhere around North Ryde/Macquarie area.

    The police initially charged him with speed racing, however the charges dropped to reckless driving.

    The whole thing takes 12 months in court, with total legal cost approx. $10k, and his license suspended during that time plus another 12 months, before probation after.

    Basically, if you want to drive fast, find a track, and do it over there.

    Something is really wrong with this country if someone I know (perhaps me) looses 3 demerit points for doing 116km/h in a 100km/h zone (1 hour west of Griffith, middle of nowhere country NSW), and this clown looses only 6 demerit points for being 80km/h over a 60km/h limit (presumably an urban zone).

    Wouldn't 1 point lost per 10km/h over the limit be a fairer linear approach, to an offense that becomes exponentially worse?

      A more cynical me would suggest that by losing fewer points per offence means that the state could get more fines out of you before you actually lose your license. So the guy losing 6 points will still have the opportunity to speed again, and pay more fines.

    Queensland license holder. Once been driving 180km/h on a 100road in NSW. Reported by a truck driver and have been followed by the police for about 40mins until I slow down to 140km/h. Then I was asked to pull over. Got a $2400 ticket and immediate license suspension but the police did not take my license. When I was back in QLD. I was still driving and speed again, pulled over, the police did not know that my license was suspended.

        Anyway I was refering to someone who did the similiar speeding thing & hide themselves among the crowd and keep neg rape. They didn't stop and reflect to what they did before they neg. I bet most of the driver had the silly moment when they are speeding without any conscious reason.

        I mean we're not really that Emphatic with the OP, we rarely reflect and put ourselves in his shoes. It might be true that maybe some never brainlessly speed over 45 km (especially in 50 or 60 km area where there is more crowd) but instead of helping & giving advise here for OP not to do it again, we OZB community were trying to become SOcial Justice Warrior & like "I never did that, so you're the scummest of scum in the earth.", alienating and making him even more depressed which in the end doesn't make the situation any better.   • its normally $2360 +6 Demerit points and Car impounded for 6months unless you are not the owner then its the responsibility of the owner to claim from police impound, may include a fee, you will be required to attend court and possible 6months jail time or probation depending on the seriousness of the crime and if anyone could have been injured at the time of being caught, if it was a speed camera you can try wheazel your way out of it by saying it was the car next to you that was snapped and they got your plates aswell but if a cop got you with a lidar detector im pretty sure you are done.

    Reality check you are not a racing driver and if so you are obviously a tight arse by not practicing your sport in a controlled environment namely a race track.

    Why should children, the elderly and cyclists be put at risk of injury or death because you are stupid. I hope the judge gives you what you deserve (unlikely to happen).

    As a regular motorist (18 years experience) I have driven many times along the M80 (western ring rd vic) littered with speeding cameras and not single fine. So speed cameras are not rigged (apart from a few years ago) and the people who keep getting fined do so because they are stupid and don't learn their lesson.

    I happen to know somebody quite well who actually did 160 in a 60 zone, just to see if he could, when he was younger. And stupider. There were no side roads and it was 2am or 3am. This justification didn't get him out of the fine the cops gave him. But they did find it amusing that he wasn't a d*ck about it. In fact, the first thing they said to him was: "You've got good brakes". Seriously. No loss of licence either. They purposely gave him the minimum fine. He recounts the way to deal with the police (and all other people) like this: (1) Don't be an a**hole. (2) Repeat continually in perpetuity. I like his style. At least how he deals with humans, which is kinda like how I deal with sheep. Personally, I may have done (insert unpublishable number here) in a 100 zone, once. But that was in NZ, and some of the cops are still sheep there. They didn't even try to stop me, I just wound down the window and yelled BAAAAA as I flew past. They thought I was their cousin. Gotta love NZ. It's choice. Bro.

  • Hope you learned your lesson mate, if you tyre pressure was low or if you took a corner too sharp with some economy tires you could have crashed your car.

    Next time, ensure you're running a proper suspension setup, some good pads (I recommend QFM HPM's, manufactured locally and have phenomenal performance) and most importantly, good tyres such as the Michelin PS3's or Hankook V12'S if you're on a tight budget.
