$60 Discount Voucher, No Expiry Date, Business Won't Accept

I have a $60 discount voucher to a puzzle escape room business - a friend won it at the opening of a cafe/bar. In the terms and conditions there is no mention of expiry date but when I emailed asking to clarify what "at time of booking" meant they came back with:

That voucher is no longer accepted at our store as the ****** opening was a year ago and we are no longer affiliated with the company.

What rights do I have? I thought that ACCC suggested 2 years minimum expiry date but I couldn't find anything online to prove this. Is the business within the rights not to accept?

Would publicizing it help? I haven't named the business yet as we haven't gone yet.

Our booking is tomorrow so I need answers quickly please.

  • Would you be able to provide/link us with the voucher's full terms and conditions? There may be other clauses which the business might be basing their claims on.

    Either way, the ACCC doesn't suggest nor enforce anything like a minimum validity period for vouchers and the like. Decisions pertaining to factors such as how long a voucher is valid for and the conditions associated with claiming are wholly up to the business' discretion.

          Vouchers aren't normally like that. They have logos/markings so they can't easily be copied.

    Vouchers and gift cards: must clearly display the expiry date. This includes the activation expiry date for cards that need to be activated before use …..Customers can lodge a complaint with ASIC about non-compliant gift cards.

    It's from the Consumer Affairs Victoria website, but it says 'The Australian Securities and Investments Commission (ASIC) has set requirements for vouchers and gift cards, based on the Corporations Act 2001.'…so I guess it's nation wide.

    If they are a different company and can show that then your recourse is with the company/entity that issued the voucher.

    If they are the same company/entity then what NancyCat says would probably apply.

    Thanks for everyone's thoughts.

    The business has after calling them and threatening ACCC & Fair Trading plus telling them I am a repeat and loyal customer (went to the previous 2 out of 3 puzzle rooms) I have gotten the discount. Yeah!
