Cancel Order from Dick Smith?

I ordered a Kindle paperwhite a few weeks ago that was set to deliver 1.5 weeks ago. Dick smith worker said theyre still waiting for stock.

Should I cancel the order due to the all of the troubles with them being liquidated? Is there a chance I won't get a refund if I wait longer?

    If you've paid anything already chances are you can kiss the $ goodbye.

    All pre-administration lay buys, deposits and gift cards are more or less kaput.
    If you get the device consider yourself VERY lucky but there is no chance you will get a refund now or anytime.

        As of the administrators taking over… yes. They can't and won't be refunding if unable to supply.

        One of the reasons they're in this mess is they can't afford to buy new stock as their banks won't loan them any more money and suppliers are wanting cash upfront.

        Thus, if they currently don't have stock of something, for the immediate future, they're not likely to get any more stock.

          … but from what I hear they're still selling Kindles. So I ordered something they said they have but they don't.

          I'm almost 100% i'll get a refund. Seems like common sense. Or else I'm going to friggin rob a Dick Smith and get my money back.

          @joeno: dude calm down, educate yourself about when companies go into administration and most certainly do not steal from a DS two wrongs don't make a right

        • @joeno: That comes with the Jail time should you get caught while doing so. Instead, you could go in store and talk to someone and see if you can buy any alternative product and then sell that product online to recover your money.

        just go into the store and get the refund right now then while you can, don't wait just in case mate.

  • I think the worst thing you could do at this point is cancel. They have already said no refunds of deposits. Best thing you can do is keep in contact with them and hope they eventually deliver.

    did you pay by paypal? if so, I think you can lodge a dispute, or may be get your bank to credit it back for you?

        Uh no. You lodge the dispute via PayPal as that is how you PAID. You didn't pay eBay, you paid PayPal…

    they said no stock, no ETA but i can wait or pick something else.
    my respond is give me full refund.
    at the same time i do paypal dispute.

    they're still selling kindles so they should definitely have them in stock. maybe you should ask them if you can pick it up from a store with it in stock

      You came here to ask for advice. You are getting it and now you're wanting to rob a Dick Smith? At most they owe you a few hundred dollars. Banks are owed 150 million according to news reports. I'd hate to think what you'd do if they owed you that much…

      We can't give you definite answers. Your best bet is to go to the Carlingford store and ask them politely. Remember the staff there will be out of a job soon, the whole Dick Smith closing down thing wasn't their idea, and certainly is not something they wanted. It's my local store and the staff have always been friendly and helpful.

      AFAIK PayPal will need you to liaise with the store first to see if they can supply you with the product. So go in store and ask them what can be done. If they can't get you the Kindle and are still offering to refund, then take the refund.

      You seriously want to commit a crime and potentially have a criminal record, serve time etc? Either wat keep us updated with the outcome …whichever road you take!

      • Just pointing how how ridiculous it would be if they can't provide a refund. It's like they have stock… but screw it we're going to take your money and give you nothing.

        • Yep, I agree. However, when a business goes into administration, apart from the business itself if it isn't bailed out, then it's the little guys like us who get screwed as we are 'unsecured' creditors.

    1. Earlier advice that was given not to cancel, was before they knew you had bought on ebay and paid using paypal. If you had paid by credit for example, then cancelling would likely make the chance of getting any money back more difficult (if any chance existed in the first place, which is unlikely). Why is it unlikely? Because of the way they've been flogging off stock recently. It's unlikely there will be anything left to convert into $ to pay anyone anything. The stores would be rented. The stock has gone. Wages and entitlements are owed. You'll be last on their list. Since you bought on ebay, and paid via paypal, let's forget all that anyway and move on…

    2. What usually happens when you buy something ebay and the seller doesn't send it? You open a dispute. There's a limited time to do that. So if you haven't done so, do it immediately. Forget any previous discussion with DS. You gave them money, they gave you nothing - you don't owe them, they owe you. They listed an auction, you paid, they didn't send it. Case closed. So start fighting to get back what's yours, or you really will wave both goodbye. Even if they intend to do right, how do you know that won't change tomorrow. That the person that told you finds a more secure job. Or the computer the record of your payment is listed on isn't being carried to someone's car right now to partically cover what they'll never receive in wages. A: You don't.

    3. Whether the time to open an ebay dispute has already expired or not - go through Paypal to get your money back - at the SAME time.

    4. Depending on how your Paypal is funded, also go to your bank. If it was by credit card - they can't hold onto your money. Similar advice has already been given in the media. Claw back your money while you can.

    In short, don't wait based on a gamble. Or you'll probably get nothing. No one is selling DS stock. DS have no money to buy stock. Your money has already gone into some DS expense. The people still working at DS (are they even open and trading!?) won't keep working for free - so they'll walk out at the first secure job if they haven't already. So whoever made any promises to you - will they walk back in just to fullfil the promise they made you?

    But you got it cheap maybe. Still want it… This makes no sense. Getting your money back and paying more somewhere else, is far better than not getting your money back and still paying more.

    You have more chance open to get your money back than many do. Take it.

    The only other thing I might consider (which is a few steps backwards from what makes sense) is ringing around stores looking for one. But I don't think that will work. Even if they have one, they will say it's not up to them - it has to be arranged through head office, thereby sending you in time-wasting circles again - when you could have used that time to be proactive and get your money back. Any staff there will have bigger worries of their own. The easiest thing for them to do is to make you any promise that gets you off the phone.

    ebay dispute.
    Paypal claimback for goods not received.
    Bank refund.

    When one of the last two works, drop the other.

    Edit: You're not cancelling. Leave the "order" in place. Claim for goods not received, not cancel - otherwise there's no transaction evidence to take to paypal/bank.

    • Thanks. I've opened an eBay dispute. I can't do the claimback on paypal. It just links to Ebay.

      Also it was funded through PayPal balance so no bank transaction was recorded.

        Holding onto a PayPal balance for more than a few days / weeks is not the best idea either.

        But, the above advice is very sound. There were a few hundred customers who got burned in the IceTV collapse last year and the ones that walked away without losses were those who immediately contacted PayPal and asked for a full refund due to the merchant not delivering the goods.
