Public Holidays Counted in Work Annual Leave

Dear ozbargainers,

My sister is working full time in child care. We are not sure whether counting public holidays as annual leave is right?

  • Annual Leave is Annual Leave, public holiday is additional.

    If you are talk about bank holiday then it is different story

    Had that in a contract once, didn't realise until after the pay (or lack of) came through.

    So just double check her contract.

    It's messed up that it's included in some contracts :/

      You can't contract something that breaches legislation
      Annual leave is covered by the Industrial Relations Act and the National Employment Standard. You cannot clear annual leave on a public holiday.

      Probably a HR department.

      I've had an employer try and make me sign a contract that denies sick leave if you don't get your flu shot and get sick. Turns out someone in HR was trying to make a name for himself…. and he did ;)

      • not sure whether its the manager of the centre or HR fault. Since its a public company

  • public hols don't count with annual leave but they do with long service leave.
