Is Behaviour against T&Cs Condoned by OzBargain?

If a deal or comments contravene T&Cs or reference behaviour that is not in line with the T&Cs for the offer, what is OzBargain's position on this?

e.g 1. Menulog T&Cs state that vouchers should not be published without written permission

Menulog 7: No Voucher may be copied, reproduced, distributed, or published directly or indirectly in any form or by any means for use by an entity other than the original recipient, or stored in a data retrieval system, without our prior written permission. In particular, Vouchers distributed or circulated without our written approval, for example on an Internet message board or on a "bargains" website, are not valid for use and may be refused or cancelled.

When a deal posts a voucher in contravention of the T&Cs, is this grounds for un-publishing the deal?

e.g 2. T&Cs for voucher use typically indicate that the voucher is able to be used once per customer or once per household.

Menulog 8.3: each customer or household is limited to one Voucher per promotion or offer

When a deal or comments refer to making multiple accounts to exploit the offer, is this grounds for editing the deal?

I note that the deal posting guidelines do not cover compliance of a deal with the T&Cs of the deal itself (other than encouraging inclusion of relevant T&Cs in the deal).

    There's plenty of examples where deals have been pulled at the request of a vendor because it breaches the T&C's.
    So no, OzB doesn't condone breaching T&C's.
    But it also doesn't have a full time lawyer to comb through the legals for every deal.

    I think if menulog were unhappy with their voucher codes being published, they would already have contacted the mods to have menulog banned. The fact this hasn't happened to date is probably a good indication that they don't particularly care.
    If they truly cared, they'd only offer account specific codes in which case, sharing the code would be pointless.

  • Many companies write T&Cs so they have the right to reject offers IF they want to, not because they intend to.

    Also, the issue you highlight is really between the purchaser and menulog. Scotty is a reasonable guy, if they've got an issue with it, they can always contact him.

    Finally, it doesnt really tell you how he takes advantage of the offer, he just implied he knows how

    • "I'll push you down the stairs" vs "id hate for you to fall down the stairs". Both you can INTERPRET as the same thing, but the first one only is a threat

        Yeah fair enough. I just thought I might add a bit of subtle humour in the OP but I didn't acknowledge the true nature of it being able to breach the T&C's at that time so I edited it again with the intention it was harmless.

      So far I haven't received anything from Menulog. Yes we do take down offers posted by members if the merchant thinks that it's inappropriate. At the end of the day we are aiming for win-win for both the consumers and the merchants, as at the end of the day it's Menulog that provides the deal, and we all lose if they no longer promote with coupon codes.

      Therefore I agree with @roughana's edits. Calling us "professional so we can use the code multiple times" might just be tongue in cheek, but inappropriately boasting about being an OzBargainer might actually hinder us from getting more bargains.

        The intention with that statement was never to boast, merely to reiterate that we're professionals in what we do (bargaining). ;)
