eBay - Buyer Dispute Advice

Hi All

Can you please advise me what to do here?

I am just a standard guy (not a business) who got brand new phone in replacement of faulty phone from techrific.com.au. As it was brand new but couple of years old model, I chose to sell off on ebay and get latest model.

The brand new phone on ebay is sold for $330+ but my price was $250. It got sold quickly. After 20 days buyer came back to me disputing the case saying that phone is not brand new.

The phone was brand new in packaging from techrific and I have email from techrific saying it is brand new. The buyer took phone to a technician and technician quoted $60.00 for repair and said it is refurbished to the buyer.

I am now in dispute of this case with ebay as they took decision to go with buyers story even though I submitted proof from techrific that it is brand new. Ebay has asked buyer to send phone back to me which I have not yet got it.

In the mean time, I have disconnected Paypal from ebay account and also remove by bank/credit details from Paypal. Ebay has no mean to debit my account. I have the money for the phone.

Not planning to use ebay now for anything - they can close my account.

My argument to them is that, the phone has been to private tech (buyer stated this in one of the communication) and it has void the warranty as I do not know what has been done to the phone. I also asked for proof from them about phone being refurbished.

Should I continue to dispute? Do I have any chance here?

  • Same thing happen to me unfortuantly ebay always sides with buyer I no longer post my items because of this. I contacted Fiar Trading & EBAY made a '' on time exception''. I suggest you either contact Fair Trading or Financial Ombudsman especially if you can prove everything.

    you lost because what you have is evidence, but not proof that the item you sold and shipped wasn't opened or used. pp will by default conclude that the buyer should get a refund and the item returned to the seller.

    very smart and should be the first thing non-store sellers do after getting paid.

    there isn't much pp can do now after you removed the funding sources.

  • Have you communicated with eBay on the phone or email? I find a lot more goes in my favour when I ring compared to email disputes

    I think you got scammed. I hope you have a photo of the phone's IMEI because I suspect the buyer is trying to return an old faulty phone.

    what was the problem that needed $60 repair from a phone technician?

    Thank you for suggesting Fir Trading and Financial Ombudsman. I shall do this, if ebay keeps its stand. I am just afraid of them sending this case to credit rating agency etc..

    1) PP balance is $0.0 - I transferred money from PP to bank straight away. I have my money, Ebay or Paypal have no mean to just debit my account, ebay and paypal are disconnected and paypal has no details about my credit/bank details. I am happy to close both accounts once this issue settled down.

    2) I have communicated my issue with ebay but as usually customer service is from foreign land and they dont like to study the case - just reply to whatever email. Phone to them is hopeless - on hold for more than 40 mins to talk to specialist. I will call them as per suggestion.

    3) I have a photo on listing which contains sticker on the phone - the photos on ebay itself is only for the packaging. As I wanted to sell phone in sealed packaging. Lets see what comes back.

    4) Buyer has not provided any evidence yet and I do not think he has it anyway. That's why I am sticking on this point and bases my argument on it. No mention of problem that needed repair.

    I do not want to cheat, I would have accepted return if it was straight after buyer received it and he did not go to private tech for fix. I am just not happy that he used it for three weeks and then raised dispute.

    I am annoyed and angry, so I will charge ebay for my service and time spent on this case. I have an ABN (loss making business with no revenue) I have told ebay that I will outsource this communication to a business (my business). From business, I will send them invoice.

    I will update you on what happens next. Lets see how far I can drag and what I get out of it. I will post update here for others to learn.

  • What's the buyer's feedback rating? If just a new buyer, most probably a scammer.

    These types of BS and my own experience with the non-existent Paypal Seller Protection is the reason I closed my eBay and Paypal accounts.

    • The feedback rating doesnt really make a difference these days since sellers cant give buyers negative feedback :/

      • It's not about seller leaving feedback. It's a check for how long the buyer/scammer has been on feeBay

  • Be careful yes paypal can't take money from you but I heard they are using xxxxx debt collectors agency regularly so they might come knock your door.

      don't worry about the arl. op can legally dispute this so called debt. the arl is then required to cease collection until pp can establish that op is liable to pay.

  • The buyer usually has 30 days grace to return it or contact you if something goes wrong. It does seem odd, why you would close your pp account & don't care if your eBay is closed also?
    I've never had any problems as a seller or buyer, if I've done nothing wrong it has always been resolved in my favour. If I was the buyer and find out you've closed your pp account, I would be worried as that sounds dodgy.

  • FYI, 12+ years as a ebay member and 300 + transactions (I am not a business so number is less) - never had any problem. This is the first time that I had to dealt with this sort of buyer. I have come across buyers who buy but not pay and ebay resolved those cases in my favour

    Reason I closed down my PP is because their policies. On 21 st day they credited my PP account in full (released hold) and then after couple of days put hold on my money as soon dispute case created. I also wanted to secure my fund and did not want PP to automatically withdraw money in this case. Dodgy seems to others but I am just trying to save my hard earned money.

    I dont like PP anyway as it is not good for seller and prepaid credit card or credit card protection does the same thing. PP also charges bit of money if you want to withdraw - I will prefer bank transfer next time, no charge at least

      I too have over 300+ and am not a business and for the record I never have money in my pp account, it's linked to my bank account.

  • I did have a very bad experience with both Paypal and Ebay as a buyer. Both's so claimed refund policy cannot be trusted . Everything is O. K. with them if you don't claim for a replacement or a refund .i.e. they are O. K. if only you don't give them any problem . I had closed both my accounts with them and prefer to contact direct with the sellers using my debit card account which was specially created for online purchases and where I keep a very low balance just to meet the prevailing payments( this being the best advice I got from my banker).

  • Somehow, buyer sent phone back to me one week ago which has not yet reached to me. Usual AusPost stuff-ups, buyer has raised customer enquiry in AusPost about this. Ebay sent me below message, decision and comments contradicts. Anyway, I think it as I win because I did not lose anything and matter is not concern to me now.

    The buyer returned the item without authorisation and did not provide tracking information for the return. You don't need to do anything else.

    • Typical ebay roll over and tickle me decision for a scamming buyer! They get a full refund (in this case provided by ebay) and get to keep the item (I assume it hasn't been sent back). I've had a few like this.

  • They may get debt collectors after you but if you do give a refund and phone is not returned via. Registered post or has been tampered with start your own dispute against the buyer.

  • Things have gone worst after good news from ebay.

    The buyer has raised case with her card provider, they then disputed charges with Paypal. Paypal sent notice me about the dispute. I then sent my full explanation with all documents to cover every angel of the case I can think of to make my case water tight however Paypal said I lost and buyer won (anyone surprise?) I do not have my item bakc from the buyer and I lost case and I have to refund to the buyer - so I have to fight same war twice and losing the item as well as payment.

    Paypal sent my details to debt collector, so I have again disputed this case with FSO. Now in waiting from Paypal for response.
