PC Byte Just Scammed Me?

Hi guys, my friend bought a optical drive for me (lg bh16ns40) worth about $85, which is able to play dvds and blu rays and gave it to me after two weeks the purchased date. I was busy and didn't have time to install it and it went over the 30 day ebay money back guarantee period. When I installed it and tried to play blu ray disc it didn't read it at all. I got it out of the pc and then, I realised on the optical driver that it said model: gh24nsd1. The optical driver I got from them can only play dvds and it's only worth $30.

So now I'm wondering if my friend is still eligible to get a refund after the money back guarantee period ended. I didn't think PC Byte would be this crude… or careless considering they are a proper store.

EDIT: Happily got a replacement. PC Byte ran out of stock on the optical drive. (probably why they sent the wrong one).

    Simple mistake in shipping , have you notified PC byte?

    • I've told my friend to request a refund, still waiting for a response. Ebay also says to return the driver. My friend didn't use paypal so the return fee might have to come out of our pockets.

      • Where are you located in Sydney? Their store is located at Lidcombe, you could take it in and explain the situation if you live close by.

        Paypal offer up to $45 per return, maximum 6 returns a year. Keep your receipt. I had to return a parcel to the USA , and as postage was $53, I only received $45 back but in your case you will be fully covered as postage/registered might only cost $20 all up.

        • @altomic: I hope the OP's friend learns from this experience. Who doesn't use paypal to buy something on eBay!? All the discount codes they'd miss out on, purchase guarantees and fraud protection, ability to review transactions in one place, choose between payment methods etc. Its like being offered a free extra service but rejecting it.

    If it indeed was a scam, if your friend was more astute, wouldnt they easily be found out ? Its propably just an honest mistake. The problem is now pc byte will propably think you are trying to scam them, they will think that you actually did recieve the right item, and are trying to pull a fast one over them. There is no way to prove you are in the right, so you should propably just make an ebay claim and let them handle it.

  • So you realised that you had the wrong product after 30 days? It would be hard to convince the seller that they have sent the wrong product and you have not swapped it.

    • That's what is worrying me. My friend took too long to give it me - no expert on computer stuff too. Hopefully they don't see it that way.

    First of all, you weren't scammed.
    You got a $30 item for $0.
    Your friend spent $85, and practically "threw it away" when he gave it to you.
    So no-one is really at a loss here.

    Thus if you don't rectify this issue, just remember, you got a free item and your friend was going to "waste" that cash anyway.
    People spend much more than that amount on things that they use far less.
    You can treat this as a life lesson: money (just like space and time) is a finite resource. You should always inspect an item (and contents!) thoroughly as soon as it arrives. Complications are much more easily believable AND rectified in such instances.

    Now moving on… since this is an item bought by a business licensed in Australia, you have consumer rights.
    Your consumer rights that you have in retail, are forwarded unto online sales too.
    As long as your friend can return the item with all contents (box/manual not important), and have proof of purchase, and (isn't lying about the issue)… then you are entitled to a full-refund. You the consumer can choose for a replacement, or store credit if you want.
    You won't receive this treatment unless you action your consumer rights. You can count on ACCC for assistance.
    But remember, if you "cheat", this will hurt ME the consumer. And other consumers. And eventually the system will collapse, and it will hurt you.
    So respect everyone's rights, please.

    • I didn't give all the details otherwise it'll get complicated but let's just say I don't exactly get it for 'free'. And yes, I wouldn't really call it a scam - it just seems like one. Thanks for the consumer rights advice.

  • hmm, your friend bought a optical drive. Why couldn't you buy it? considering your close to the store 'PC byte'? Something is missing from this problem.
