New Nexus 5 Phone from DWI Arrived Faulty, Now Dead after 8 Days. DWI Refused Refund Request and Will "Fix"!

Hi

I purchased a new Nexus 5 phone from DWI (see https://www.ozbargain.com.au/node/266588?page=1#comment-4078…). the phone turned up in my mail box one day, no tracking, no pick up, no courier as the Ebay deal suggested.

Since having it, it has been temperamental and two days ago it just failed to boot, despite all my attempts at soft and hard resets it just beeps and does not turn on.
I escalated the issue on Ebay, and DWI are suggesting they will fix the phone. But it seems like another Ozbargainer got a dodgy phone on the same deal so I am thinking this "fix it" offer is just bullsh@t, right?

So should I just keep demanding my money back from them? or ignore them and escalate through ebay?

    They offer a 14 day DOA warranty, but that's 14 days from invoice date… I'm assuming it's gone past 14 days now?

      eh purchased on the 19th Sept, received on the 30th so their warranty was pretty much done by the time I got it.

      After I saw someone else had been punked on this deal I escalted straight away.

      Also the courier made up a signature and left the parcel, so it's all been a bit dodgy

    This is why I stay away from online shopping for phones. The 50-100 you save isn't worth the hassle.

    Better to just buy it from JB Hifi or someone local. If things go wrong, you just turn up in store and they take it from there.

      Yeh cheers, bought my Moto 3 from TGG. I purchased the Nexus through this mob as they were claiming an Australian warranty. This will be the last time I deal with time wasters like this.

  • Regardless the 14 days return policy you need to demand the seller replacement phone or if refund ask them to pay for the postage return before you post it back.

    Let them know that you are expecting the postage return provided or paid to you within say 3 days or else you will escalate dispute to eBay customer service.

    If they don't you simply just escalate the dispute to eBay customer service.

    As long as you are not threatening the seller with negative feedback for full refund and keep your messages clear and professionally eBay should sided with youand provided you with full refund.

  • Thanks everyone, the cheeky buggers want me to accept their terms conditions before they will consider my claim. Their T&Cs erode the PayPal guarantees so I have refused to sign.

    I'm the third Oz'ber to get a dodgy Nexus 5 from them.

    It's in the hands of PayPal/eBay now, as they refuse to acknowledge my claim for a refund…..

  • Just some follow up, the escalation to Ebay was essential who ruled in my favour.
    DWI paint themselves as having an Australian presence, but in my experience this is BS, there posts sales/returns is also complete BS.
