OnePlus 3T from BuyMobile Listed as "Brand New" Turns out to Be Used

Just received a "brand new" phone from BuyMobile only to find out there were multiple remaining image thumbnails on the phone. The images were downloaded from chrome on the 28th of February 2017, yet I have just received this phone today on the 14th of March 2017. I'm unsure what action to take about this. If I were to refund my phone they would likely still maintain this deceptive practice which is presumably against Australian Consumer Law, so do I need to get in contact with somebody? Any suggestions would be appreciated.

  • What's the physical condition of the phone?

    • The phone is physically pretty much perfect, the dates of the thumbnails seem to suggest it was only used for one or two days then returned. I probably won't refund it just to avoid a customer service ordeal, but it was used nonetheless.

      • I know sometimes they open up the seal and test that's it's all working before it gets sent to you. Saves you getting a doa.

        Up to you but I personally won't be too fussed if it's physical condition is perfect. It's a lot of effort to chase up in my opinion

          I doubt they tested it by downloading 11 pictures of anime girls. Yeah it does seem like quite a difficult issue to tackle with the company. I might just leave this forum up for anybody doing a customer experience check on the company before they purchase, and leave it at that.

  • First, are you sure you are not dealing with grey importer? Never heard that shop name. Why not just buy from stores you see from ozbargain like Banggood etc?

    • They were the only company that appeared to provide a decent Australian warranty and sold the a3003 international version of the phone rather than the a3010 Chinese version.

      of course it's a grey importer. oneplus doesn't sell their phones officially in Australia.
