$3109 Fine for 105KPH in 100KPH Zone

Yep, in Victoria, apparently doing 105 in a 100KPH zone in a company registered car, will get you an Infringement Notice for $3109, which "may be" reduced if you nominate the driver.
I believe the fine may then be reduced to $194 and ONE Demerit Point.
While I don't have a fundamental problem with this, it's just another government pig in a suit.
Is it reasonable to expect an eBay/Gumtree market to develop in this price structure?

  • My wife got one for that amount as the car is registered under a business. Once she nominated her self it was a lot less.

    it is in place to deter people with deep pockets from hiding behind their company name and do whatever they want on the road.

    that max markson guy apparently racked up like $30k worth of fine in his company's name.

        Its pretty obvious why it's done though.
        Many people have already said why.

        Unless someone really wants to speed or run red lights and is willing to pay the crazy amount you would have to be out of your mind to pay it as a company.

    Your mentality if flawed, I'm sorry that your brain (or school) failed you.

    Let me explain why the law was made to avoid the past loopholes.

    You have 12 demerit points to spend.
    Your company has unlimited points.

    You make a company within minutes, transfer the car on that company and drive worry free of points and the possibility of having your licence suspended.

    The government said: I'm ok with that, but you have to pay a premium for that cool feature. You can have unlimited points for $3000/each infringement notice. Don't like the premium? Nominate the person who's driving.

    I might have missed the meaning of this question, but the massive penalty is in place to encourage the company to identify the driver of the vehicle so the correct person can receive the (much smaller) fine and the demerit point(s). If they don't nominate the person who deserves the fine, the company has to pay the big fine. I don't see any problem with this. If you were speeding, be honest and own up to it.

    • That's exactly the point of the large fine.
      Previously the fine charge was the same, or not much more than the normal fine. And companies would simply pay it and not nominate the driver.

      Looks like the OP opted to falsely nominate someone and then try to get out of it.
      For this, the internet gods will punish him severely.

    $3109 fine is there to reduce the abuse of the system/ close loophole for drivers getting away with demerit points for car under company name.

  • I wonder what would happen if a nominated driver nominates another driver which in turn nominates another driver and so on and so forth…

  • It could be worse, if for example the legislature had imposed the same responsibilities of ownership on companies (i.e. the directors) as they did on the natural person, whereby if you are the registered owner (as a natural person) you must provide information about the driver of a vehicle to the police (section 60 Road Safety Act Victoria), and if you fail to then you are liable to have your license cancelled for 2 years (4 years with a prior).

    So many people are not aware of the effect of this law, wrongly believing that they have a "right to silence". Pretty common scenario is that the police seek to intercept a vehicle, but are unable to. Driver pulls up at home and police are not able to say who was driving. They identify the registered owner who refuses to say who was driving the car 10 minutes ago (said registered owner is often drunk).

  • This is a deliberate thing - company I used to work for had company cars, and a fellow employee got a speeding fine for about this much.
    It's because the car is registered to the business, not the individual (this fine is aimed at the business).
    If the business nominates the driver who committed it, it's just then a regular speeding fine.

    The idea is to make the staff that drive the cars accountable for their actions.

    If you're the owner of the business, you could likely still nominate yourself.

    Logic behind the pricing scheme should be pretty damn obvious. It's to give an incentive to the company to bring the culprit to justice. $3k sounds pretty cheap. The pricing structure should really be gross income tested if they're really serious with things, which they're not.

  • It is to force someone to take the points, old scam that you could use a company car to dodge license suspension.
    NSW did it by forcing someone to be the responsible owner so if nobody will be nominated they suffer the points.
    Very large fine method is fairer, since it is not really reasonable to expect some senior manager to be across every staff member who takes a company ute etc and they have to go on holidays and stuff.

  • This was the case in NSW that led to the harsh treatment for infringements on company cars with no nominated driver
