Employees Are Paid In Cash

Good morning

I came across a employee who works at a famous service station and the employer is paying him flat rate of $15/hr on cash. And he told me that the employer is keeping a false time sheet.

I advised him to contact Jobwatch. What advise would you've given to him?

    The person is getting paid cash because they're working beyond the hours allow on their visa class. Make a fuss and get their visa revoked.

    By the time you report employer,you lose the job.Usually this happens to a low skilled occupation because it is too easy to find the next person.

    If the service station is doing it to benefit the business, report them.

    If the service station is doing it for the benefit of the employee, talk to the employee and ask for a cut as hush money ;)

    paying cash is seems norm, check at chadstone shopping centre… quite few (food retail) fast food stores are paying there staff in cash. I came to knw 3 cafes over there, who is doing it. Everyone has diff justification of doing it, diff reasons.

    even 1 cafe owner took a money (50k) to sponsor that employee for visa purpose. no super, no sick leave, no no annual leave. employee turning up at work every day until gets PR.

    If you talking about BP, Shell, Caltex, 7eleven service stations, its most common practice for years. Everyone knows and no one knows about.

    • No one is going to spend $50k to sponsor a waiters Visa. That doesn't make sense.

        The cafe owner took it, not paid. And the visa above may refer to a cook, restaurant manager position, not a waiter.

        its the business owners asking for money ( can be anywhere b/t 5k-70k) because they know the person situation that he/she needs sponsorship from the business ( who meets certain IMMI criteria) to obtain a work visa/PR.

        apart from above, in Caulfield Race Course (Horse Racing) esp. during Spring Carnival Event. A cleaning contractor of this venue hires b/w 100-300 ppl ( mainly from word of mouth) and pays them on cash. All of these ppl are mainly students (SE Asian, South Americans, locals on dole), senior citizen, recent migrants looking for jobs.

        He is been doing that years, even Melbourne Racing Club (MRC) is aware of this. MRC manages caulfield, sandown and quite few pub/tabs around them.

        Problem is widespread, if you see that as a problem.

        If you ask student, why they doing it. Some says 20hr work restriction is not enough for them make both end meets and pay for uni. Its hard for them to find a job without permanent residency visa and this job suits them as can work day/night time.

        If you ask senior citizen, center link payment is not enough to make both end meets.

        If you ask business owner, he is not $$$ making money out of it and is helping everyone out incl. himself.

    You'll never guess what goes on in famous restaurants and luxury hotel chains. It's standard operating procedure for some of the largest businesses in Australia to conduct criminal activities for profit. It seems to exist across industries rather than across the board.

    Meanwhile one of the gummints response to the brain dead morons who voted them in is to start collecting metadata on every single one of the innocent people that these business are profiting from illegally.

      or $17.70 hourly

      if they work casual (which is very unlikely)
      then it's per hour: $23.32

        And if it's full time then also sick leave, holidays etc.

        More than likely is casual so the higher hourly rate.

        And also super and penalty rates to be paid.

        The staff member is being ripped off.

    Lodge a report on the above link. Cash payments are all too common. The ATO is doing a bit of a crackdown at the moment too (though with such a big problem it's hard to see much change).

    Whether it's to the employee's or employer's favour it hurts us all if someone isn't pulling their weight and paying tax….And yes even the 'little guy's.

    • If they want to see change, the government needs to realize that there are a lot of students and international migrants don't actually have a lot of choice:

      1. They lack language skills and as a result can not find legitimate jobs, so they work the lowest skilled jobs they can find. Low-skilled jobs typically pay cash-in-hand, their income is not declared, and there is no super or worker's compensation.

      2. They are stuck doing these jobs and cannot 'dob in' their employer because there's nowhere else to work. If they dob in their employer, they are immediately out of a job.

      3. Many of these migrants lack formal education or training, and with no system in place to upskill them they're forever doing shitty cash-in-hand jobs.

      4. The government can keep playing 'whack-a-mole' and punishing businesses that are not doing things by the law, but there are a lot of dodgy businesses that slip past the radar and remain undetected.

    Can you give us a hint as to who the famous service station is? What films has it been in? Is it the one from 'Rain Man' or is it the one from 'Zoolander'?

  • It sucks that they are being ripped off. There is speculation about over working on a visa. As long as that is not the case, tell them to keep a detailed work log, then go to the gov

  • Paying on cash is common for low paid occupations. Reporting the employer would result in the loss of job of the employee in which case the employee would face difficulties. Just ask the employee what's his job nature and whether he has signed an appointment letter mentioning about salary on cash or so… If not, then it's better for the employee to maintain a record for his monthly salary in black and white.

  • Cash in hand is a two way street, don't butt in unless asked.

      One of my favourite jobs of all time paid me $10/hour cash and fed me at the end of the night, still a job I look back on fondly.

      More recently, I did a one night spot where I was paid in vouchers (to be used at the business I worked), looking forward to doing that one again too.

    • The employer can not use the cost of employing someone as a tax deduction to their business, when the employee is paid in cash. So in effect, he/she may be doing their business a dis-service because when they go to sell it or are having to provide Profit and Loss statements to a 3rd party, it will not show the true costs of employing people. Instead it should cost more - and so might make the figures look better but when new owner goes in - they won't be able to make the business work as the figures are incorrect. Because the costs are incorrect - any business owner is going to struggle and look for ways to reduce costs.

        If there paying employees in cash, chances are they're also pocketing cash from their sales and keeping it off the books too.
