eBay & Paypal Dispute Denied - What To Do Now?

OK I'll cut this story short, I bought an item from eBay which turned out to be fake, eBay denied refund because the seller gave me a fake address and I received the item back. I then disputed through Paypal they accepted the return and gave me an address to send to, they asked only to provide the tracking number.

On the tracking site it tells me they attempted to deliver on 7 different occasions but the seller must be rejecting the parcel. Now Paypal asked me for additional evidence which I do not have as the tracking only provides the postcode and city. Paypal denied my claim because of this.

Any suggestions?

Paypal payment linked up to my bank account, not Credit Card.

    • Too late now,the item had been sent over a month ago. I know for next time going by this experience.

      The reason I didn't because PayPal said I only needed to show them tracking number and proof of postage

      • Nah, they like proof of delivery. Just delivery, not necessarily to the right person. To ease confusion, let me explain a few things.
        Aus Post will not share information without the permission of the person launching the enquiry to do so.
        AP will only run one enquiry on a tracking number at a time.

        eBay think anyone can access results, and there is no privacy laws and AP do not refuse to share information/results.

        I had an item vanish a couple months back, tracking marked delivered, but it wasnt. I spoke with Aus Post office, they said ask sender to launch enquiry. So I did. Meanwhile the next delivery day post office monkey on scooter is at our door, monkey on scooter says sorry but he couldnt fit it in my letter box so put in neighbours and I should check with them. WTF?

        When seller asks Aus Post to run enquiry, he failed to allow sharing of information/results. According to AP, they would have requested authorisation to share with receiver, and sender must have refused. I can only speculate.

        So I can not access results of enquiry, but I know what happened as monkey has told me. Im telling ebay I know, Ive shown them evidence from AP that what the monkey told me is consistent with what they have, but as sender refused authorisation they cant go into it more until the enquiry is finalised. But it was ample and supported what I was telling them. Nope, ebay seemed unable to read. They kept insisting I could access the information, and note, each time Im talking to a new ebay munchkin that cant be arsed reading, just skims and auto responds. So this part was circular, a lot.

        I argued with ebay, one munchkin at eBay extended deadline for 3 days (yay they can read), including weekend to supply evidence item was not delivered to me (at this time sellers AusPost enquiry was still running so i could not access information/results)

        End result of enquiry, post delivery monkey now says he might have put in wrong letter box, wasnt sure (not quite what he told me) but still proof the item delivery is not mormal. But as item is marked as delivered, end case as far as PayPal and eBay were concerned.

        The Monday, end of the 3 days, I get the proof from Aus Post as they launch a new enquiry when they finished the sellers, and they will only do one at a time, but eBay says although the new deadline had not passed, they should not have extended it as all they can go on is the tracking that says delivered. Aus Post enquiry stating misdelievery was likely, was of no value and should never have been asked for.

        I thought I was on prank show. Couldnt have been more twisted and provocative if they tried.

      I left a 1 star rating on the listing item review, eBay only published the 5 star review. I only mentioned that the product is no good and I would recommend it.

  • Tell seller that you are about to do bank charge back and inform seller that they won't be happy to get charge back fees of $15 thus it's best for seller to do easy refund. Give them 2 days to do abything.

      The seller doesn't care i said many things to him, he doesn't reply.

      First time i sent item to him he gave me a fake address, then i received the item back and ebay said i shouldn't of sent it before confirming with ebay, which is stupid because i didn't escalate to ebay as the seller agreed to refund me. Which is another lesson i know now

    Don't waste your time with PayPal & eBay anymore. Go direct to Financial Ombudsman Service and lodge a dispute against PayPal.

    PayPal will cave within 48 hours and "as a gesture of goodwill" [yeah right!] credit your PayPal account with the full amount. If you need further support, search OzBargain for "paypal FOS goodwill"

      Thanks that's what I was after, didn't know i could use them for Paypal, i've used them before for insurance claims. Unfortunately I don't trust both companies anymore. Going by the experiences lately they're both sh;%

        Wow, that is a lot of coin to have given up on!!! Given the large amount PayPal might not credit you within 48 hours 'as a gesture of goodwill' but certainly if they have been unfair then the FOS will take care of them and should find in your favour. Best of luck with the claim

    I had a similar issue,(I ordered a watch and got a lucky charm). Paypal/Ebay insisted I send the fake item back to get a refund. Fortunately I checked the address they gave which was nothing more than a City, Country. No Street address.
    I called Paypal, you always get put through to a dumb clerk who gives answers off a Q&A screen. Again they said post if back even after explaining the address they had provided was wrong. I insisted on talking to their manager, explained it all again and was refunded within 15mins. If they have provided you with a fake address then call them back, insist on talking to someone with authority and explain your case again.

  • Yeah… I had a similar thing happen.

    Purchased a Bronze Vase (I wont go into details).
    The seller sent a Silver coin.

    I was angry that I was scammed, and researched the coin.
    It was valued (from another site) the same price that I paid for the vase.

    I was still pissed off, and chucked it to one side.
    I then noticed it was stuck to a magnetised screwdriver. Silver doesn't do this.

    Armed with this information, I photographed it being picked-up by the weakly magnetised
    screwdriver, and sent the photos with a message "Please explain, this is obviously a fake".

    Refunded within 1 hour.

    You have to play the game their way.

    • Wait until the day after the longest delivery time/date.
    • Send a email to the seller, (via ebay), asking for tracking advice, as there seems to be NOTHING showing.
    • Wait another 4 days for the seller to respond.

    More than likely they will refund you before the 4 days are up. (If they have other complaints about the same seller)

    • From now on every eBay dispute I will escalate and let eBay sort out everything, they will also provide the return address.

      I won't communicate with sellers these days as most lie.

      Its a lesson learnt, but I've bought many things on eBay in the past and never had any dramas

      • Beware though, once in dispute there is a time limit that is ticking down. But you often have to wait for responses and allow time for the courier etc to get back to you. And obviously the courier have to allow time for the other party to respond so they have time allowances of their own and must give the seller time to respond. Seller only has to ignore the couriers requests and the eBay timer times out while the courier is waiting. Then the courier gets back to you, you get your proof but eBay has shut the door. If you delay launching the eBay dispute, you might align the stars better.

    If the seller is clearly in the wrong they'll just deduct from their paypal and credit yours.

    Trying to get money out of them though is a different story. I had a long wait on one refund, broken deadline, then partially paid, now still waiting for the rest.

      IMO the seller is clearly wrong, I have not received any refund.

      Doesn't look like you know what your talking about, going from my experience for the refund.

      How am I trying to get money out of them, when I've wasted $44 on return shipping (twice I've sent the package) to be refunded $60?

      • I've had a couple of experience where it was no problem, BUT I always use Paypal that sucks from a credit card.

        This implements an extra two levels of protection and liabilities for them and they know it.

        I know you are feeling injustice but frankly paying from a bank account is asking for it. Put it down to experience this time if your efforts fail.

        In future, I'd suggest to always use Paypal from a credit card. I don't like the commissions they charge either but the best outcome and protection for us is to use their system.

        • I know now. This is the first time I've had an issue with a dispute. Which is why I never used cc to pay via PayPal.

          I think I will start paying with cc from now at checkout

    go to Ebay home page on top right hand side you will see <ADVANCED>click then next page go to bottom left hand side then at bottom you will see<FIND CONTACT INFORMATION>click then next page fill in details asked for then send and wait for reply from EBAY,good luck,do not ever send anything back until you put in a claim and receive details back from EBAY,good luck

    DON"T return ANYTHING unless instructed by eBay.

    CONTACT eBay FIRST, they will fwd your message to the seller, like I said wait until the LAST delivery date has passed.

    Remember you are NOT dealing with the seller at this stage.
    Ebay will step in, and they know when, or if, the seller replies with 8ull5hit.

    Maybe, you've learned now for next time.
    Most sellers are honest (or I would like to believe).

      This guy has been a problem right from the start selling me a fake item and all the bs he's been telling me.

        It took a couple weeks, but at least I got my money and the postage also. I added it for doing my head in going up & down to post office and for chasing PayPal with this stupid case. They can now chase the dodgy seller for the money, as I've sent the item twice till now.
