Legal Advice - Recommend a Workplace Injury Compensation Solicitor

Hi guys, this concerns my wife who had an injury in her workplace 2 days ago, I believe it may be negligence on their part.

I won't go into details but we would like to know her legal position. Does anyone have any firm recommendations?

We're Newcastle NSW but can travel to Sydney if need be.

    hi,

    I'm curious as to what your seeking.

    I used to be a Worker Comp Claims Manager in Vic. Then I worked for a law firm managing their workers compensation claims.

    the basis of any claim for damages for a work injury is that the injury has stabilised and is now permanent and causing a reduction in the quality of life.

    obviously losing an arm (for example due to unsafe machinery that is missing a guard) is a pretty obvious and observable and hence measurable injury.

    if it is a less of an "obvious" physical injury - i.e. back injury, then it has to be monitored over a period of time e.g. 12months to ascertain the degree of permanence.

    If you are seeking to put in a claim through workers compensation then that is different.

    your wife should see a Dr, get a medical certificate and file a claim with SafeWork NSW.

      • Thanks for your information, much appreciated. I won't go into details but she'll be getting legal advice this week. If that amounts to anything, time will tell. She has 2 medical reports already.

  • Hi had my manager call me into his office the other week and i went and CEO was there too i was told that my supervisors roll will be no more been working there for 13 years but i'm not sack and going back on the tools i went feeling a bit out wack spinning and i did'nt go to work for next 3 days i rang in every morning i was sick so on the 2nd day i went and got a stat dec for 2 days off but i had another day of so on monday when i went to work i filled out my time sheet for those days for unpaid sick leave put a extra day on the stat dec with a slightly lighter blue pen and today i got letter management for misconduct and fraudulent activity and looks like I'm getting the sack can anyone tell me am i loosing my job for adding a extra day on the stat dec form please.

  • FWIW we didn't pursue this.

    Her injury whilst nasty probably isn't considered serious in an ongoing sense, she is recovering and healing slowly but surely and the legal option was ruled out by us both mutually. We're happy letting time take care of the rest.
