Justice System Loop Hole, and Why?

I have been in an accident, sorry if I can't type properly or missing a word or two, since I cant type a lot with one hand,I'll skip the telltale part.

Summary: This girl turn right, traffic jam, can't wait anymore for traffic to stop, suddenly take the turn cuz she thinks that her SUV is a F1 car, because I'm just half a second a head than the other lane, so my bike take the full force, the quote, $2999 to fix,

Her, no insurance, nothing, no job, blah blah blah.

So it will come out of my pocket, since I cant push her insurance for it, therefore my bloody premium will increase.
Ask my lawyer friend, I can push charge but the cost for it will be more than the cost to fix my bike, unless the damage is $20k-$30k, otherwise it is not worth it.

After a whole week chasing goose, if your car is old and if your skill is high, avoid it as much as you can, don't make the damage too high, don't buy insurance because your car is old, cheaper to scrap it. Unless that person press charge, otherwise you will walk away fairly easy. As the girl in my situation has demonstrated.

        • @hunterhalo: Good on you for doing it - people don't learn from their mistakes if there aren't consequences, and you can't put yourself at a disadvantage on the behalf of someone who might be laughing to their friends about how a nice guy sucker decided to save her having to pay to replace his bike.

        • No not at all, he was yeah yeah to me ans i asked is that a definitely yes or yeah yeah, and im asking some more technical questions and found out that no, but well i gave them a chance and surely he knows shit

    I had a simialar situation occur to me but my car was totalled. Entering into an exit from a major road I had to slam on my breaks to avoid hitting the car that was broken down on the exit… the car behind me wasn't able to stop in time and slammed into me and then my car hit into the car broken down in front too (hence why my car was totalled due to front and rear damage)

    Unfortunately both myself and the driver behind who hit me only had ctp and no comprehensive cover. So that left me up shit creek without a paddle.

    Maurice Blackburn Lawyers, they specialise in this type of accident. They won't take on the case unless it's certain someone else is at fault and you're entitled to compensation. It won't cost you anything during, but they will take a percentage of the payout.

    Dude this is the only advice you will need, forget all the internet lawyers on this site. Go blow up your car and call the feds then say your car got stolen then wait and then you will get 80K in the sack go to cass and bet on black go get a rub and tug with the winnings go home sleep

    My advice would be: Lodge a claim with your insurance company - Provide all her details (They will chase her! You don't need sob stories, She is responsible for her actions. so now it is time to get back to the position you where prior to the loss.)
    Lodge a claim with CTP for injuries - I believe you need to do this with in a certain time from the incident.
    - You don't need any lawyers. (No offence to lawyers) All pretty straight forward.

      This might be the reason for OP's behaviour. Hot girl flirts with him and gives sob story about having no money. OP becomes mesmerised and agrees to not call insurance. Now he only has one hand to type with.

    There is wayyyy to many comments to read through, and I'll assume it's been addressed, but if not this is what the deal is.

    She hit you. She has no insurance
    You have insurance.
    You claim against your insurance, they fix your stuff.
    You get on with your life end of story.

    Your insurance will now chase up the money to repaid from the girl.
    They will Persue her over the next year or sox and in the end they will offer her a deal where she has to pay 10 a week for the next however many years and the call her every 6 months and say if you give us x amount of money we will finalise it.

    This is why you pay your insurance for them to do this hard work
    Your no claim bonus will stay the same and your premium will stay the same (will increase every year as they do)

    You are worrying about nothing.

    What kind of 1st world country doesn't require at least 3rd party insurance for cars? It's beyond my understanding.

      +1 on that. Never could understand it. And if it was compulsory for all vehicles, it would cost even less than it does now, which ain't that much.

    2. your insurance will pursue the girl
    3. the girl legally owes your insurance.
    4. you are not to pay any increase in premiums or any excess. Any additional increase in permiums would be minimal compare to you paying out this in total.

    Go to court, get a judgement against her but don't enforce. Judgement stays for like 15 years and goes on credit file, therefore unless she will never require any credit, never work and get assets, you have a chance to get the money back. Plus interest accrues at 10% pa, take as an investment with a potential payoff sometime down the track. At a minimum, you will make life difficult for her.

  • Hey OP, I had the exact scenario around Christmas, some guy hit me, no insurance, so I went through my own insurance who chased money from him.

    So definitely go through your insurance!

    Also, not sure if you're in VIC, but in VIC, you could get your medical costs covered by TAC.
