Bad Experience with Becextech Australia

Hi,

I happened to buy iphone 6 64gb $459+$29 shipping thinking the iphone is brand new. I didn't know until I placed order and then discovered under condition tab that it is not brand new but restored to new condition. The description is quite deceiving as nowhere in lading page it says anything about refurbished item. Within 30min of order placed, I requested refund. They replied that there will be admin processing fee of $35. I got refund minus $35. I replied with to get me full refund and correct item description clearly mention that the item is refurbished and not new. I am thinking lodging a complaint to nsw fair trading to get full refund. They don't seem to refund full. I will never recommend buying anything from this company, they seem to sale all refurbished products advertising low price with high shipping cost.

  • I don't see they mention new in the listing. You can't always assume it's new.

      It is not also mentioned refurbished until you visit condition tab. If it is not mentioned refurbished, it implies as new product, it's quite obvious to fall into that trap.

      Disagree - other iPhones on the site have "REFURB" in the title, by omitting it in this one, I'd presume new as well.

      Dog behaviour by becextech to mislead like this in the first place, double-dog to then try charging a return fee for an unshipped item. It's too connected a world to treat your customers like shit.

      If a site has a condition section, thus this is correct way to do normally.

      It's really up to the site to list the condition as well in the title to emphasize, but to not mention it in the title, not necessarily meant it's new.

    Their return policy:
    BecexTech also offers 14 days POM(Peace-Of-Mind) return policy. All POM returned product will incur charge for re-stocking fees. The charge may varied depending on the item condition. However, BecexTech reserve the right to refuse the return if the product is not in reasonable condition.

    So I guess as the product not even shipped yet you should be able to get 100% refund. Let me know if I miss anything?

    Bad Buyer.

    From the ad:

Please kindly refer to our warranty policy for further information or contact our friendly CS for warranty claim. "

    Very obvious that it is refurbished.
    It's stated/hinted numerous times, whereas they've only ever mentioned "new" only once.
    A Brand New iPhone will be sealed, it won't be opened or tested, and it won't require any renewing, restoring, or use of parts generic or otherwise. And it won't have a 1 year warranty (I believe its 2), and the warranty will be handled by Apple and NOT this company's CS group.

    On top of that, if you wanted "BRAND NEW" rather than "New/Refurbished"… you should've purchased it from the Apple Store (or a listed reseller such as Telstra). Its quite a common knowledge.

    With that said, if you paid via PayPal… you might possibly be able to threaten/push the seller to do a full-refund.
    Hope you learn from this, and that it all works out for both parties.

      Bullshit. Any company who doesn't mention the fact that it's a refurb/restored/second hand etc phone in the title and/or main description is trying to deceive it's customers. Yes, it's mentioned in the condition tab, but I wouldn't think to check the condition tab for an item that is presented as if it's new.

        It never said anything about it, so as a buyer, you're first thought would be to think "is this Used, Refurbished, or Brand New".
        You would question it. And after you do so, if you click on the "Condition" tab, you would see clearly it is a refurbished product.

        I mean its one thing to say it wasn't in the title, but its something completely different to say this particular ad was maliciously deceptive.
        The buyer simply didn't do their due diligence.

          Where is it resented as new??? This is an "etailer" that predominately sells new, grey market electronic items. The phone isn't listed under their "Open Box Specials" tab in their site navigation, it's advertised under their regular mobile phone category, alongside all the brand new phones.

          To navigate to this particular page I'm not clicking on any sub-section for used or refurbished items, and if I refine my search via the left sidebar once I'm in the 'mobile phone' section, there's nothing to indicate there's a mix of refurb and new products listed here, nor any way to filter between the two - just brand and price filters. And when I reach the product page, it's a standard Apple product image depicting brand new phone bodies.

          Go to Kogan's site - nothing on their iPhone 6 product page specifically states its a brand new product either, yet I bet you don't read that listing wondering if its new/used/refurbished.

          becextech have deliberately formatted their product listing here to present it as a new phone, omitted any reference to its refurb status in the title and product description which are the obvious places to mention it - it's deceptive practice, deserves to be reported, and I don't understand why anyone would want to defend them for it.

          @dm01: hard to argue this. I agree it is somewhat misleading but from a different perspective, you can also argue that OP did not read the item description fully. It is not clear cut.

        • @Bluberry: If it were listed under their 'Open Box' product section, or some other section for refurb/second hand items, I think it would be fair enough to expect shopper to check the condition tab, but when it's presented like this, alongside other brand new phones, without the word "refurbished" or the like mentioned anywhere in the title or description…why would you have any reason to question whether it's new or not, and then go looking for a condition statement elsewhere?

          As I mentioned in an earlier comment, there are other iPhones listed on there that do have the word "REFURB" clearly stated in the listing title, so if you were browsing through and saw one with "REFURB" in the title, then clicked through on another without….wouldn't you think it's new?

          @dm01: hmm..lots of sellers do that sort of thing. Look at all the overseas sellers that take a month to deliver who say they are based in Darwin! Ebay/Paypal will usually not rule in the buyers favour unless it is clearly the sellers fault. The seller will simply argue that it was in the item description. Good luck getting the $35 back.

        • @Bluberry: This isn't a Chinese eBay seller pretending to be in Australia…it's an Australian registered business so is actually subject the laws and requirements we have here.

          And I'll mention it again…it is not stated in the item description that the phone is refurbished - go read it!

          @dm01: from a legal perspective, the item description is not just the text under "item description". Its the information contained within the entire listing including information under the "condition" heading.

    • The point is it's not mentioned in the title but somewhere far from title or description which is condition tab and Condition tab does not necessarily mean its about Item Condition, it could mean for some other condition such as shipping or condition of order … Its mentioned refurbished in a decisive way.

    OP, I'd be arguing with becextech that their product listings are inconsistent and deceptive. SOME refurb items have "refurb" in the title and description, while others (such as the one you bought) have that information omitted until you go to the product page and into the condition tab. Take some screen grabs before you do this so you have proof, in case they decide to change the product pages when you complain.

    And I'd definitely lodge a complaint with fair trading too.

  • Now I know why this bad store still can survive, apparently still many people simply googling for the lowest price and buy from whatever Google put on the top list.
    If only you search that store name in ozb before committing, you will never buy from them.

    I would not waste time on arguing on it's Refurb or New, but try to put more of your energy on the return policy of the seller as it's part of why you buy from the seller (even you may not read it anyway). This is enforceable in Australian law.

    I don't see seller mentioned $35 in the return policy and I don't see why seller want to make $35 out of cancelled order for the sake of customer service.

    OP, I am sorry this happened to you. Becextech is not a great store to buy stuff from but ultimately it is your responsibility to protect yourself by reading the full description carefully before any purchase. Sellers will always try all sorts of things to make a quick buck at your expense. At worst you will only loose $35. Some stores do not accept refunds at all.

    There is a legal principle that underpins all purchases, Caveat emptor, quia ignorare non debuit quod jus alienum emit ("Let a purchaser beware, for he ought not to be ignorant of the nature of the property which he is buying from another party.")
    This means that the buyer assumes the risk by making reasonable checks prior to purchase.
    I would argue that clicking on the tab that says "Condition" is a reasonable requirement for a purchaser.

  • That product listing is very misleading - it totally looks like a new phone listing. Yes, they state re-furbished in a separate tab that will often get overlooked, but we all know they are trying to mislead, and no doubt often succeed in being misleading.

    Sorry it cost you $35, but take comfort in the knowledge that it will cost them much more than that in lost sales. Dodgy product listing, even dodgier after sales support - how many people have read this and will steer well clear of them and advise others to do the same.

      I read their "terms and conditions" - there is no mention of the $35 admin fee in the T&C's that you apparently agreed to as per this page. It's written in "Engrish" anyway - good luck to them if they ever do have to defend it in a court.

      Neither does their shipping and returns policy - in fact, a quick scan through their site and I can't find any mention of it - did they display a different set of T&Cs when you placed the order? Sounds like something they only mention when they have to defend charging it. Once again, I'd be grabbing screen grabs of the current T&Cs as proof of this "fee" being made up or hidden. The restocking fee shouldn't apply, cause it never left their stock.

      I'd write back, restate your case, lean on the inconsistency of their item title and description omitting the terms "refurbished", remind them that you requested cancellation in a timely manner and prior to shipping, and also mention that at the top of 'Return' section of the 'Shipping and Returns' page, it states; "At BecexTech, we ensure that you will not regret with your purchase." and state that a $35 fee for a non-shipped order request is causing you to greatly regret placing an order with them.

      Finally, mention you'd prefer not to take further action, but as there are inconsistencies in what their T&C's/returns policy states when compared to their current action in withholding the $35, if they choose not to return the $35, could they please provide contact details of their Australian legal representation for you to pass on with your complaint to NSW Fair Trading Department.

      Regardless of their reply, I think it's still contacting fair trading/consumer affairs and getting their opinion on the whole new/refurb situation - I'd be surprised if they didn't consider the product page misleading.

  • I know im probably late but i also had a bad experience.
    First phone, couldnt update due to being an american variant and needing an extra sim card.
    Sent back, got a replacement
    Replacement worked for 2 weeks, before the /System folder got corrupt.
    Just got my new one, was scared it was fake, but its fine.

  • THEY ARE REFURBISHED - Don't do it to yourself

    The apple Iphone I received appeared to be original when it arrived. It worked fine, however after 3 months failed. I took it to an authorised apple repairer who opened it and saw that the parts were not genuine. Becextech failed to honour the warranty I have lodged a complaint with Consumer Affairs

    On 22/12/2017 I had purchased a camera, lens, mobile and accessories from BecexTech. As of today, I have only received the camera and lens. The accessories are missing and the mobile sent was used and faulty. As I desperately needed a phone I had to paid $400 to repair my existing cracked mobile, hence I have no use for another phone, nor do I want a faulty used phone.

    As of today, BecexTech have ignore my request for a refund and insisted that they have done nothing wrong. Will be reporting them to fair trading, ACCC and any other legal bodies where appropriate. Please walk away from this unethical business and tell others not to shop from them.

    As per 87B Undertaking - BXT International Limited - signed 12 December 2017,

    BXT International undertakes that for all products advertised for sale on the BecexTech website which are not new for the main headline description to start with “REFURBISHED” OR “USED”. And not "Special Price Renew Samsung Galaxy S7 32GB 4G LTE" as was the case with me.

    BecexTech Australia has admitted that it has contravened the Australia Consumer Law in the way that it described its products and responded to requests for refunds. BecexTech Australia have misled me into purchasing a 'used' product believing it to be 'new' and genuine.

    Under the Australian Consumer Law, consumers are entitled to choose to receive a full refund of the amount they paid for a product when that product failed to meet the consumer guarantees. For my purchased order of $6,371.50, which included a camera, lens, mobile and accessorises, I have only received only the camera and lens. The accessories are missing and the mobile received was 'used' and faulty.

    As per court enforceable undertaking, BXT International Limited are to provide the shipping cost for the return of faulty goods. Therefore, I expect a refund of purchased price $6,344.95 + return shipping $26.55, total $6,371.50.

    The business refused to refund me my money and insist that they have done nothing wrong. Any help?

  • I AM GETTING SCAMMED BY BECEXTECH RIGHT NOW!

    2 weeks ago today I ordered an expensive Sony telephoto lens, confident that within two weeks I would have delivery (based on many 3-4 day deliveries from B&H New York and DJI Hong Kong). I used an address I have been working at for the past 2 weeks in Sydney until I left there today.
    After the order, having not got a tracking number for a few days, I emailed the first of many futile conversations with 'Zlatan' and 'Ryan'
    I was given a DHL tracking number which lay idle in status 'received paperwork Hong Kong'.

    So I guess Becextech is not supplier from Australia in spite of every indication on their website. The tracking number remained static for days, So another email to Ryan met with a response that they had lost the order. I said send another one, but they kept asking me to be patient. After reminding them that I won't be at the address soon to collect it, they then told me that it hadn't been sent as they were out of stock. A refund was politely offered and I politely accepted. Yesterday I purchased the lens locally in Sydney. An hour later an email arrived stating that it was on its way with a new tracking number from a ficticious transport company with a picture of a parked truck and a tracking input box which is fake and doesn't work.

    After I threatened to call my bank and call them out as a fraudulent company, They suddenly are able to reverse the shipment?? after they take a $55 fee.
    I have now accepted that fee just to get them out of my life. Especially now that I have since bought locally.

    Ryan must be a very busy person defending his company's policy to rip off Australians.
    Still, after reading some posts, there is a good possibility that a faulty second hand piece of rubbish might turn at the location I was at until today.

    How can you send this item when you said it was out of stock.
    Now instead of using your previous courier DHL, you are now sending it by a company where the tracking number supplied won't even work.
    I wont be at that address after tomorrow.
    Your company is a scam and I will contact my bank tomorrow and report the transaction as fraudulent.
