If You Are a NZ Resident for Tax Purposes Can You Claim Self Education Expenses for Australian Tax Purposes

No, haven't spoken to a tax agent, but just wondering whether anyone here knows…and i will if we move to NZ….
Let's say your an aussie living in NZ. We have a dual tax treaty between our countries.
NZ does not have any accommodation for work related expenses to claim back via taxes (or am i incorrect in stating this?)
Can a person claim back work related expenses such as studying while working via the ATO in this circumstance?

  • If you're not paying tax, how is the tax man going to reimburse you for the expenses? Cant you try and claim these expenses when filing for NZ tax this financial year?

  • Are you planning to sever all ties (as in, absolutely) and move to New Zealand permanently? If not, chances are the Double Taxation Agreement will mean you're still an Australian for tax purposes.

    When you read all the conditions (it's different for trusts, businesses, property, employment under local company, employment under home company etc etc) it's actually rather convoluted if you've never done it before.

    But most tax agents I've dealt with are absolutely useless.

  • I would say no as you will not be incurring any expenses that is related to employment in Australia. But if were self employed in Australia and resided overseas for study related to your work then possibly you could claim ?

  • There isn’t enough information in your question. If you are a NZ resident for tax, then you would be taxed in NZ on your worldwide income.
    If you earn any income in Australia, then irrespective of your residency status you will have to lodge a tax return in Australia. Non residents don’t receive threshold exemption and every dollar is taxed, unless there is any additional arrangement for NZ residents which I have no knowledge about.
    When you lodge Australian tax return, your would then be able to apply as deduction any expenses incurred to generate that specific income, includes self education expenses. Mind you your education expenses must meet the test criteria.
    Now to your NZ tax return, you would receive a foreign tax credit for any tax paid in Australia. So, this is how your Australian self education expenses would have an affect on your NZ tax.
    I am not sure how NZ treats foreign income and tax paid on it. But I would hope that it wouldn’t be much different from the Australian system.
